SUBJECT:

A resolution authorizing the Director of Purchasing to accept per ton dump fees from Rochelle Waste Disposal for the disposal of non-special and special excavated soil.

 

PURPOSE:

The purpose of this resolution is to provide a means for the City's Water and Sewer Maintenance Division to dispose of spoils that cannot be disposed of as CCDD material.

 

BACKGROUND:

35 ILL. Adm. Code 1100 requires testing of soils excavated from sites with a history of activity that may have resulted in soil contamination. The code also requires that spoils excavated from residential sites be tested for pH. Soils that do not meet the requirements for disposal at a CCDD landfill must be disposed of at a facility permitted to accept such contaminated material.

 

The City of Aurora's Water and Sewer Maintenance Division regularly generates excavated spoils while maintaining the City's water and sewer infrastructure. Environmental consulting service is required to classify excavated spoils for proper disposal. Depending on the results of the soils analysis, spoils are disposed of as CCDD, non-special waste or special waste.

 

DISCUSSION:

On July 23, 2025, the purchasing Division opened proposals from two landfill operators. The proposals were evaluated based on per ton dumping costs, trucking expenses, and costs to comply with landfill specific testing requirements.

 

Funding is provided in the 2025/2026 budget in account 510-4063-511.36-13.  The 2025 budget includes $200,000 for non-CCDD and CCDD landfill expenses. Based on historic activity it is estimated that approximately 5000 tons of non-CCDD spoils will be generated within a 12-month period. This proposal is for a one-year period with an optional two-year extension based off of pricing provided.

 

 

IMPACT STATEMENT:

This resolution is needed to provide a means for disposing of excavated soils that are generated on a day to day basis by the City's Water and Sewer Maintenance Division.

 

RECOMMENDATIONS:

WHEREAS, the City of Aurora has a population of more than 25,000 persons and is, therefore, a home rule unit under subsection (a) of Section 6 of Article VII of the Illinois Constitution of 1970; and

 

WHEREAS, subject to said Section, a home rule unit may exercise any power and perform any function pertaining to its government and affairs for the protection of the public health, safety, morals, and welfare; and

 

WHEREAS, on July 23, 2025 the Director of Purchasing received two proposals from landfills for the disposal of excavated spoils that cannot be classified as Clean Construction Debris; and

 

WHEREAS, the proposals were evaluated based on proximity, travel time, and testing requirements; and

 

WHEREAS, the evaluation revealed that the proposal submitted by Rochelle Waste Disposal is the most economical of the bids received for the City of Aurora; and

 

WHEREAS, said per dumping fee is valid for 12 months with a two-year option, and

 

WHEREAS, the 2025 budget included funding for this expense in the Water and Sewer Fund within account 510-463-511.36-13; and

 

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Aurora, Illinois, as follows: The Director of Purchasing is hereby authorized to adopt the per-ton dump fee submitted by Rochelle Waste Disposal.
