SUBJECT:

An Ordinance Changing the Name of Elm Street to West Park Avenue located between N. Lake Street and N. River Street located in Kane County, Aurora, Illinois  

 

PURPOSE:

The City of Aurora is requesting a street name change of Elm Street to West Park Avenue located between N. Lake Street and N. River Street in Kane County, Aurora, Illinois.  

 

BACKGROUND:

In the mid 90's the City of Aurora reconfigured the intersection of West Park Avenue and N. Lake Street to align with Elm Street on the east side of N. Lake Street.  At that time, the City also changed the name of Elm Street to West Park Avenue.  Kane County recently brought to the City's attention that this street name change was never formally changed with the County.  Therefore, this street name change will change that portion of Elm Street to West Park Avenue. 

 

DISCUSSION:

The Street Name Change will allow the city to continue to use West Park Avenue. 

 

IMPACT STATEMENT :

The Street Name Change will have no impact as the property owners are currently using West Park Avenue.  Without this change it will impact a large apartment as the address would need to be changed.  

 

RECOMMENDATIONS:

The Staff recommends APPROVAL to the Ordinance Changing the Name of Elm Street to West Park Avenue located between N. Lake Street and N. River Street located in Kane County, Aurora, Illinois.

An Ordinance Changing the Name of Elm Street to West Park Avenue located between N. Lake Street and N. River Street located in Kane County, Aurora Illinois

WHEREAS, the City of Aurora has a population of more than 25,000 persons and is, therefore, a home rule unit under subsection (a) of Section 6 of Article VII of the Illinois Constitution of 1970; and

 

WHEREAS, subject to said Section, a home rule unit may exercise any power and perform any function pertaining to its government and affairs for the protection of the public health, safety, morals, and welfare; and

 

WHEREAS, desires, pursuant to Section 42-3 and 42-20 of Article I of Chapter 42 of the Code of Ordinance, City of Aurora, to change the name of a former portion of Elm Street to West Park Avene as hereinafter set forth

 

NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Aurora, Illinois, as follows:

 

Section One: That the City Council of the City of Aurora, Illinois finds as fact all of the preamble recitals of this Ordinance.

 

Section Two: That this Ordinance shall be in full force and effect, and shall be controlling, upon its passage and approval.

 

Section Three: That all Ordinances or part of Ordinances in conflict herewith are hereby repealed insofar as any conflict exists. 

 

Section Four: That any section, phrase or paragraph of this Ordinance that is construed to be invalid, void or unconstitutional shall not affect the remaining sections, phrases or paragraphs of this Ordinance which shall remain in full force and effect.

 

Section Five: That the name of former Elm Street be and is hereby changed to West Park Avene, located within Section 22 of Aurora Township, Kane County Illinois, all as shown on the plat map attached hereto as Exhibit “A”, and made a part hereof.

 

Section Six: That the City Clerk of the City of Aurora, Illinois, is hereby directed to forward a copy of this Ordinance after its passage and signing to the Director of Public Works so that the street sign may be changed, the Aurora Police Department / Communication - 911, and the Fire Marshall so that the name change may be noted on the “emergency response maps” and to the Zoning and Planning Director so that the name change may be noted on the Official Zoning Maps of the City of Aurora, and record this Ordinance at the Kane County Recorder’s office.
