SUBJECT:

A resolution to increase the reimbursement to Kane County from $249,000 to $444,861.22 for water main relocation associated with the new Jericho Road Bridge over Blackberry Creek in Ward 5.

 

PURPOSE:

Increasing the funds as proposed herein will allow the City to fully reimburse the County for the City portion of the project.  On August 26, 2014 the City entered into an Inter-Governmental Agreement (IGA) with Kane County, in which the City agreed to reimburse the County for the costs associated with water main relocation; the IGA is attached as Exhibit A.  At the time of the IGA, the estimated scope of work included the relocation of one water main and the estimated cost was $249,000.  Based on field conditions, actual bid prices and final measured quantities, two water mains were relocated for a final cost of $444,861.22, therefore additional funds are required to fully reimburse the County. 

 

BACKGROUND:

The City maintains and operates various utilities throughout the City, some of which are not located on City property and are generally located within easements.  These easements are granted by property owners and in some cases other government agencies.  One such location is Jericho Road, which is a Kane County Highway, with two water mains located within the R.O.W., a 16" distribution main on the south and a 12" well collector on the north.  In general, when water main is installed within another agency R.O.W., the installation is only allowed if the City guarantees that they will relocate the main upon request if it interferes with any proposed improvements.  In the case of Jericho Road, the water mains needed to be relocated due to the construction of a new bridge over Blackberry Creek.  In many cases, the City would develop plans and specifications for the water main relocation and competitively bid the work in advance of the County project; in this case, the work items were added to the County's plans for the bridge replacement which was also competitively bid.  In many cases it is advantageous from a timing and coordination standpoint to proceed in that manner, rather than designing a standalone project.  This also required an IGA between the City and the County outlining the reimbursement.  At the time the City entered into the IGA, the costs for relocating one water main were estimated at $249,000. 

 

It was not initially anticipated that the 16" water main would be in conflict with the bridge.  As work progressed, it was apparent that it would also need to be relocated.  Therefore, the County processed a change order to relocate the second main.  That, in conjunction with actual (not estimated) bid prices and final as-built quantities resulted in a final cost of $444,861.22.  Accordingly, the funds allocated to this improvement need to be increased by $195,861.22, as shown on "Change Order 1" which is attached as Exhibit B. 

 

DISCUSSION:

This project was required to maintain safe travel within the City; although Jericho Road is a County Highway, it is used often by City residents.  Kane County's total cost for the replacement of the Jericho Road Bridge was $2,399,455.81.  Relocation of the water mains to maintain service to residents was required due to their proximity to the new bridge.  The 2017 budget has been amended to include the reimbursement costs in account 510-4063-511-73-04.

 

 

IMPACT STATEMENT:

This resolution will have no impact on other divisions or the public, as the work is compete.

 

RECOMMENDATIONS:

I request the proposed resolution be adopted.

WHEREAS, the City of Aurora has a population of more than 25,000 persons and is, therefore, a home rule unit under subsection (a) of Section 6 of Article VII of the Illinois Constitution of 1970; and

 

WHEREAS, subject to said Section, a home rule unit may exercise any power and perform any function pertaining to its government and affairs for the protection of the public health, safety, morals, and welfare; and

 

WHEREAS, the City owns two water mains that are located within County R.O.W. along Jericho Road, and 

 

WHEREAS, the relocation of the water mains was required due to the construction of the new bridge, and

 

WHEREAS, the City previously entered into an Intergovernmental Agreement (IGA) with Kane County that stated the City would reimburse the County for all costs associated with water main relocation related to this project, and

 

WHEREAS, the City is required to reimburse the County for the relocation of the two water mains on Jericho Road, for a total cost of $444,861.22, and

 

WHEREAS, the 2017 budget was amended to include $444,861.22 in account 510-4063-511-73-04 for this reimbursement. 

 

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Aurora, Illinois, as follows: to increase the reimbursement to Kane County from $249,000 to $444,861.22 for water main relocation associated with the new Jericho Road Bridge over Blackberry Creek in Ward 5.
