SUBJECT:

A resolution authorizing an Intergovernmental Agreement between the Illinois State Toll Highway Authority, the City of Aurora, and the Aurora Township Highway Department regarding the replacement of the bridge at Farnsworth Avenue and the Ronald Reagan Memorial Tollway (I-88).

 

PURPOSE:

To authorize the Mayor and City Clerk to execute the aforementioned agreement.

 

BACKGROUND:

The Illinois Tollway intends to remove and replace the Farnsworth Avenue bridge over I-88 with a longer structure so as to accommodate the potential future widening of the Toll Highway, and to make certain ramp and interchange configuration improvements modifying the interchange from a “full cloverleaf” arrangement to a “partial cloverleaf” arrangement in order to improve traffic flow and enhance safety for the motorists using the Toll Highway as well as pedestrians utilizing Farnsworth Avenue (Exhibit ‘C’). The interchange modification will consist of the removal of the two (2) loop ramps located to the east of Farnsworth Avenue and the creation of two (2) new signalized intersections along Farnsworth Avenue to accommodate the east bound I-88 to northbound Farnsworth Avenue and the northbound Farnsworth Avenue to westbound I-88 movements.  The proposed bridge will be approximately 270’-6” in length of superstructure and deck over the Toll Highway, and shall have a raised profile which will provide a minimum of 16’-5” vertical clearance from the existing Toll Highway to the bottom of the new bridge structure.  Two (2) 12’ through traffic lanes, a 10’ shoulder and a 10’ multi-use path with barrier protection on Farnsworth Avenue and a pedestrian safe wall on the outer parapet will be constructed northbound.  The bridge will feature the ILLINOIS TOLLWAY’s standard bridge aesthetics.  Two (2) 12’ through traffic lanes, a 12’ auxiliary lane, a 10’ shoulder, and a barrier wall on the outer parapet will be constructed southbound.  Four (4) newly constructed Toll Highway ramp terminals, two (2) new traffic signals with combination lighting at the intersection of the newly configured eastbound I-88 to Farnsworth Avenue and northbound Farnsworth Avenue to westbound I-88 intersections will be constructed and interconnected with the intersections of Molitor Road and Premium Outlet Mall.  The traffic signals will be located in unincorporated Aurora Township but it is in the best interest of the City to own and operate the signals and interconnect them to the Central Traffic Management center.  The intersections will include pedestrian signalization.  The traffic signal south of the Toll Highway will provide queue monitoring of the eastbound I-88 exit ramp to Farnsworth Avenue.

 

DISCUSSION:

In this agreement (Exhibit 'A'), at the request of the City and Township, the Illinois Tollway will include in this project painted combination traffic signal/lighting on Farnsworth Avenue with pedestrian signalization and interconnection to the intersections of Molitor Road and Premium Outlet Mall. They will also include a 10’ multi-use path with barrier protection along the east side of Farnsworth Avenue and a pedestrian safe wall on the outer parapet of the bridge. The total estimated cost to the City for said requests will be approximately $316,076.50 (Exhibit 'B') actual cost will be based upon the awarded unit prices. The 2016 budget provides funding for this project #G020 in account 237-4460-431.76-52.The City and Township shall grant and consent to the Illinois Tollway any and all permits of access and temporary right-of-way use without charge. Jurisdiction and maintenance responsibilities remain unchanged with the exception of the new Traffic Signals being owned and maintained by the City. The Illinois Tollway has requested 3 signed copies of the attached Agreement.

 

IMPACT STATEMENT:

The Farnsworth Avenue Bridge over I-88 will be limited to two lanes of traffic during construction.

 

RECOMMENDATIONS:

Please forward this resolution to the Finance Committee for their review and recommendation for approval.

WHEREAS, the City of Aurora has a population of more than 25,000 persons and is, therefore, a home rule unit under subsection (a) of Section 6 of Article VII of the Illinois Constitution of 1970; and

 

WHEREAS, subject to said Section, a home rule unit may exercise any power and perform any function pertaining to its government and affairs for the protection of the public health, safety, morals, and welfare; and

 

WHEREAS, the City has requested that the Illinois State  Toll Highway Authority include   painted combination traffic signal/lighting on Farnsworth Avenue with pedestrian signalization and interconnection to the intersections of Molitor Road and Premium Outlet Mall as part of the City’s system; and

 

WHEREAS, the estimated cost to the City for these requested improvements, set forth in Exhibit "B" attached hereto and incorporated herein, will be approximately $316,076.50 (actual cost will be based upon awarded unit prices); and

 

WHEREAS, funding for the requested improvements is budgeted for 2016 in account # 237-4460-431.76-52; and

 

WHEREAS, the Tollway agrees to the City and Township's requested work as stated above and thus an Intergovernmental Agreement between the Parties is required to set forth the details of such agreement, and is attached hereto and incorporated herein as Exhibit "A":; and

 

WHEREAS, these three Parties, through said Intergovernmental Agreement, desire to determine and establish their respective responsibilities toward the engineering, right of way acquisition, utility relocation, construction, funding and maintenance of this project as proposed; and

 

WHEREAS, the Illinois State Toll Highway Authority, by virtue of its powers as set forth in the "Toll Highway Act," 605 ILCS 10/1 et seq. is authorized to enter into this Intergovernmental Agreement; and

 

WHEREAS, the City, by virtue of its powers as set forth in the “Illinois Municipal Code,” 65 ILCS 5/1-1-1 et seq. is authorized to enter into this Intergovernmental Agreement; and

 

WHEREAS, the Township, by virtue of its powers as set forth in the Township Code 60 ILCS 1/1-1-1 et seq. and the Highway Code 605 ILCS 5/6-101 et seq. is authorized to enter into this Intergovernmental Agreement; and

 

WHEREAS, a cooperative Intergovernmental Agreement is appropriate and such an Agreement is additionally authorized by Article VII, Section 10 of the Illinois Constitution and the “Intergovernmental Cooperation Act”, 5 ILCS 220/1 et seq.

 

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Aurora, Illinois, as follows: that the Intergovernmental Agreement between the Illinois State Toll Highway Authority, the City of Aurora, and the Aurora Township Highway Department regarding the replacement of the bridge at Farnsworth Avenue and the Ronald Reagan Memorial Tollway (I-88) as set forth in Exhibit "A" attached hereto is hereby approved, and the Mayor and City Clerk are hereby authorized to sign and take all actions in furtherance of said Agreement.
