To establish a memorandum of understanding between Kane County, Illinois and the City of Aurora, Illinois governing shared fiber strands and network utilization. This memorandum of understanding will cover the use of both City of Aurora fiber and Kane County fiber
PURPOSE:
Kane County currently uses strands of fiber on the City of Aurora network to gain access to both the Aurora Police Department Court and their health facility on Highland Avenue. This connection also provides direct benefit to the Aurora Police Department from technologies like video band call. In addition we are currently using strands of Kane County fiber to provide a path to the North Aurora Water Tower for our Harris Public Safety Radio System..
BACKGROUND:
The City of Aurora has made fiber available to Kane County for multiple facilities. Likewise, the City has utilized Kane County fiber to reach facilities that the City needs. This type of network collaboration will continue to grow. As it grows there will be additional addendums or exhibits to this memorandum of understating..
DISCUSSION:
Neither organization is currently charging for fiber utilization. How and where the fiber is used will change over time and will be dealt with by an addendum to the memorandum of understanding. Our fiber networks continue to grow rapidly.
IMPACT STATEMENT:
Utilization of the fiber networks and strands in this manner has been mutually beneficial to both organizations. Neither organization is charging the other for these uses. .
RECOMMENDATIONS:
I ask the members of the Government Operations Committee and City Council to approve the memorandum of understanding with Kane County regarding fiber usage.

WHEREAS, the City of Aurora has a population of more than 25,000 persons and is, therefore, a home rule unit under subsection (a) of Section 6 of Article VII of the Illinois Constitution of 1970; and
WHEREAS, subject to said Section, a home rule unit may exercise any power and perform any function pertaining to its government and affairs for the protection of the public health, safety, morals, and welfare; and
WHEREAS, The City of Aurora is currently using fiber owned by Kane County. Kane County is using fiber owned by the City of Aurora. It is therefore desirable to establish a Memorandum of Understanding between the parties to govern this shared fiber network. )
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Aurora, Illinois, as follows: That the Memorandum of Understanding between Kane County, Illinois and the City of Aurora, Illinois governing the shared fiber network as set forth in the attached Exhibit "A" is hereby adopted and approved.
