A Resolution Approving a Revision to the Final Plan to modify the building elevations for the 28 remaining vacant lots in the Tanglewood Oaks Subdivision on Property located at N. side of Galena Boulevard at Barnes Road, Aurora, Illinois 60506
PURPOSE:
The petitioner, BCB Development XXII LLC/Tanglewood Oaks as owner, and K Hovnanian Homes as contract purchaser/developer, is proposing Final Plan Revision to modify the building elevations for the 28 remaining vacant lots in the Tanglewood Oaks Subdivision.

DISCUSSION:
The contract purchaser/developer, K Hovnanian Homes, is purchasing the remaining 28 vacant lots within the Tanglewood Oaks subdivision, and asking for approval of their building elevations. Their three proposed elevations will be compatible with the existing homes already built, with the same age-targeted, 1st floor master bedroom, detached residential use as originally contemplated by the approved zoning and development. Landscaping will be completed and pedestrian pathways connected where needed. Of the three models, one will offer a 3 car garage. There will be three separate elevations available for each of the three models, with two-thirds including a brick/stone. The approval of this Final Plan for building elevations will facilitate the completion of this foreclosed development. The elevations will be similar to those previously approved. The elevations were modified after meetings with the Tanglewood Oaks Homeowners Association and staff. The HOA is now in support of the proposal.
IMPACT STATEMENT:
This development will have a positive impact for this subdivision and will result in an increased tax base for the City.
RECOMMENDATIONS:
The Planning Commission recommended APPROVAL of the Revision to the Final Plan to modify the building elevations for the 28 remaining vacant lots in the Tanglewood Oaks Subdivision on Property located at N. side of Galena Boulevard at Barnes Road.

WHEREAS, the City of Aurora has a population of more than 25,000 persons and is, therefore, a home rule unit under subsection (a) of Section 6 of Article VII of the Illinois Constitution of 1970; and
WHEREAS, subject to said Section, a home rule unit may exercise any power and perform any function pertaining to its government and affairs for the protection of the public health, safety, morals, and welfare; and
WHEREAS, by petition dated March 25, 2014, BCB Development XXII, LLC/Tanglewood Oaks filed with the City of Aurora requesting a Final Plan Revision to modify the building elevations for the 28 remaining vacant lots in the Tanglewood Oaks Subdivision for the Tanglewood Oaks Subdivision as described on Exhibit "A" attached hereto; and
WHEREAS, said Final Plan Revision was duly referred on April 1, 2014, by the Aurora City Clerk to the Aurora City Council, who, in turn, referred said Final Plan Revision to the Aurora Planning Council and Aurora Planning Commission for study and recommendation, and to the Planning and Development Committee of the Aurora City Council for final decision; and
WHEREAS, on December 14, 2004, the City of Aurora approved the Final Plat for the Tanglewood Oaks Subdivision by Resolution Number R04-510; and
WHEREAS, said Final Plan Revision has been determined to be in substantial conformance with the Aurora Municipal Code, Chapter 43 entitled "The Aurora Subdivision Control Ordinance" and with the "Aurora Zoning Ordinance" Number 3100 10.7-9; and
WHEREAS, said Final Plan Revision has been determined to be in substantial conformance with the Annexation Agreement approved by the Aurora City Council on December 14, 2004 by Ordinance Number O04-157; and; and
WHEREAS, said Final Plan Revision has been determined to be in substantial conformance with the Plan Description approved by the Aurora City Council on December 14, 2004 by Resolution Number O04-159; and
WHEREAS, on May 6, 2014, the Aurora Planning Council recommended that said Final Plan Revision be moved forward for consideration; and
WHEREAS, on May 7, 2014, the Aurora Planning Commission reviewed said Final Plan Revision and recommended approval of said petition; and
WHEREAS, on May 15, 2014, the Planning and Development Committee of the Aurora City Council reviewed said Final Plan Revision and recommended approval of said petition; and
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Aurora, Illinois, finds as facts all of the preamble recitals of this Resolution and hereby grants said Final Plan Revision
