SUBJECT:

Ordinance authorizing the sale of the easterly 40 feet of City Real Estate (LOT 14), located at 774 North Avenue, Aurora, Illinois, Permanent Index No.: 15-26-109-028.

 

PURPOSE:

Attached is an Ordinance authorizing the sale of the easterly forty feet (40’) of City real estate, Lot 14, commonly known as 774 North Avenue, with PIN 15-26-109-028, to Pedro Estanislao Rodriguez Castellanos, who owns the property directly west of the area to be sold (772 North Avenue). Under the terms of the proposed sale, Rodriguez will pay the City one dollar ($1.00) and consolidate the land with his current parcel. This sale includes all said property PIN 15-26-109-028.

 

BACKGROUND:

In February 2015 the City of Aurora purchased the property at 774 North Avenue, Aurora, Illinois with density reduction funds following a repair or demolition action pursuant to 11-31-1 of the Illinois Municipal Code. The structures on the property are raised. The property is currently exempt from real estate taxes. The lot is to be given to the adjoining land owner (Rodriguez) as legally described below:

 

THE EASTERLY 40 FEET OF LOT 14 OF KINGSBURY SUBDIVISION OF LOTS 4, 5, 6 AND 7 OF HOWELL’S ADDITION TO AURORA, IN THE CITY OF AURORA, KANE COUNTY, ILLINOIS. .

 

DISCUSSION:

The City has made this type of arrangement before with adjacent owners in order to dispose of vacant City-owned lots.

 

 

IMPACT STATEMENT:

Transfer of the property to the adjoining property owner will move parcel back to the City tax rolls and remove parcel from City maintenance.

 

RECOMMENDATIONS:

 Place on Finance Committee Calendar (6/13/17 Agenda) for approval to City Council.

WHEREAS, the City of Aurora has a population of more than 25,000 persons and is, therefore, a home rule unit under subsection (a) of Section 6 of Article VII of the Illinois Constitution of 1970; and

 

WHEREAS, subject to said Section, a home rule unit may exercise any power and perform any function pertaining to its government and affairs for the protection of the public health, safety, morals, and welfare; and

 

WHEREAS, the City of Aurora is interested in selling and Pedro Estanislao Rodriguez Castellanos is interested in purchasing real estate known as the Easterly 40 feet of Lot 14 of Kingsbury Subdivision of Lots 4, 5, 6 and 7 of Howell’s Addition to Aurora, in the City of Aurora, Illinois with PIN Number 15-26-109-028 (“Property”) in accordance with the terms and restrictive covenant set forth in the attached Agreement.

 

NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Aurora, Illinois, as follows: that the attached Agreement for the sale of the Easterly 40 feet of Lot 14 of Kingsbury Subdivision of Lots 4, 5, 6 and 7 of Howell’s Addition to Aurora, in the City of Aurora, Illinois for the sum of $1.00 is hereby approved.  Additionally, Chuck Nelson is hereby authorized to act on the City’s behalf to complete the sale of these properties.
