SUBJECT:

A Resolution authorizing the Director of Purchasing to execute an agreement with Deuchler Environmental Incorporated for assistance with analysis and certification of excavated soil for the remainder of 2016 and through 2017.

 

PURPOSE:

The purpose for this resolution request is to provide a means for the City's Water and Sewer Maintenance Division to ensure that excavated soils are properly disposed of..

 

BACKGROUND:

35 Ill. Adm. Code 1100 requires testing of soils excavated from sites with a history of activity that may have resulted in soil contamination. The soils that do not meet the requirements for disposal at a Clean Construction Demolition Debris (CCDD) landfill, must be disposed of at a site permitted to accept such contaminated material.

 

The City of Aurora's Water and Sewer Maintenance Division regularly generates excavated spoils while maintaining the City's water and sewer infrastructure. Environmental Science professional services are required to classify excavated spoils for proper disposal. Depending on the results of the soil analysis, spoils are disposed of as Clean Construction Demolition Debris, non-special waste, or special waste. Disposal costs vary depending on the classification of the spoils

 

DISCUSSION:

The proposed agreement will provide professional assistance for the remainder of 2016 and through 2017. This agreement can be terminated by the City at any time.

 

Based on recent historic data, it is anticipated that the analysis will cost approximately $35,000 for the remainder of 2016, and $60,000 for all of 2017. The 2016 budget provides for a portion of the funding for this service in Account 510-4063-511-32-06, Water and Sewer Fund. A budget transfer has been requested for the remaining estimated 2016 expense. The proposed 2017 budget requests funding for this work within the same account number.

 

IMPACT STATEMENT:

These professional services are required in order to comply with the above reference state code while performing day to day maintenance activities

WHEREAS, the City of Aurora has a population of more than 25,000 persons and is, therefore, a home rule unit under subsection (a) of Section 6 of Article VII of the Illinois Constitution of 1970; and

 

WHEREAS, subject to said Section, a home rule unit may exercise any power and perform any function pertaining to its government and affairs for the protection of the public health, safety, morals, and welfare; and

 

WHEREAS, 35 Ill. Adm. Code 1100 requires that excavated spoils that do not meet the Clean Construction Demolition Debris standards be analyzed to determine how they must be disposed of; and

 

WHEREAS, The City of Aurora's Water and Sewer Maintenance Division generates excavated spoils that must be disposed of on a regular basis; and

 

WHEREAS, the 2016 approved budget and the 2017 proposed budget provides funding for this service in account number 510-4063-511-32-06, Water and Sewer Fund; and

 

WHEREAS, The City of Aurora's Water and Sewer Maintenance Division generates excavated spoils that must be disposed of on a regular basis; and

 

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Aurora, Illinois, as follows: The Director of Purchasing is hereby authorized to enter into an agreement with Deuchler Environmental Incorporated for the analysis and certification of excavated soil for the remainder of 2016 and through 2017.
