SUBJECT:

A Resolution Accepting the Dedication of a 10 feet City Easement adjacent to the right-of-way at 233 Ashland Avenue. (Ana Zarate - L15-01049 / AU33/2-15.220-DED/E - AM - Ward 4)  

 

PURPOSE:

The Petitioner, Anna Zarate, is dedicating 10 feet City Easement to the south of the Ashland Avenue right-of-way which will provide for the installation of a new sanitary sewer to serve 237 Ashland Avenue.   

 

BACKGROUND:

The both 233 Ashland Avenue and 237 Ashland Avenue are currently utilized as a Single Family homes with R-2 zoning. The properties are generally located on the south side of Ashland Avenue, just east of Peterson Avenue.  The property at 237 Ashland Avenue was on a private septic system, however the system failed and they needed to hook onto the public sanitary sewer system.  This required that the existing system be extended from its current terminus being 100 feet to the east across 233 Ashland Avenue by the property owner Armando Garcia.   The proposed City Easement would allow for the City to maintain this new line.    

 

DISCUSSION:

Staff has reviewed the Dedication of Easement, submitted by the petitioner and have sent comments back to them on those submittals.  The petitioner has made all the requested changes to these documents and they now meet all of the applicable codes and ordinances. 

 

IMPACT STATEMENT:

The Planning and Zoning Division would anticipate that this project will increase the City’s overall tax base and viability by enhancing the city’s infrastructure and improving services to its residence.   

 

RECOMMENDATIONS:

Staff would recommend APPROVAL of the dedication of a 10 feet City Easement adjacent to the right-of-way at 233 Ashland Avenue.

WHEREAS, the City of Aurora has a population of more than 25,000 persons and is, therefore, a home rule unit under subsection (a) of Section 6 of Article VII of the Illinois Constitution of 1970; and

 

WHEREAS, subject to said Section, a home rule unit may exercise any power and perform any function pertaining to its government and affairs for the protection of the public health, safety, morals, and welfare; and

 

WHEREAS, it may be necessary in the future to construct and provide utilities in the easement area; and

 

WHEREAS, upon petition of the property owners, Ana Zarate, the City of Aurora has been offered in dedication suitable vacant land for the purpose of locating utilities and/or providing stormwater detention within an easement(s) as described on Exhibit “A” Plat of Easement attached hereto; and

 

WHEREAS, the City desires to receive and accept the granting of such real estate, in accordance with Section 11-105-01 of the Illinois Municipal Code (65 ILCS (1994) 5/11-105-1); and  

 

NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Aurora, Illinois, that upon petition of the property owners, the City hereby receives and accepts the granting of the easement(s) as described on Exhibit “A” Plat of Easement attached hereto; provided however, that such acceptance of granting does not relieve the developer of its obligations to construct such utilities in accordance with the City of Aurora Public Improvement Ordinance.
