A Building, Zoning, and Economic Development Committee Resolution Approving a Revision to the Final Plan on Lot 201, Phase II, Unit 2-1 of the Butterfield Subdivision, located at 2759 North Eola Road, for a Warehouse, Distribution and Storage Services (3300) Use (Liberty Property Trust - 19-0718 / NA05/2-18.092-Fpn/R - SB - Ward 10)
PURPOSE:
The Petitioner, Liberty Property Trust, is requesting approval of a Final Plan Revision for Lot 201 of Butterfield Subdivision Phase II, Unit 2-1, located at 2759 North Eola Road, for a Warehouse, Distribution and Storage Services (3300) Use which will include construction of new parking areas for passenger vehicles and commercial vehicles.
BACKGROUND:
The Subject Property is zoned PDD, Planned Development District. It is located in the Butterfield planned development district. The lot is approximately 17.4 acres, and maintains a warehouse building that is approximately 505,600 square feet. There are two units in this building. There are currently 410 parking spaces on the site, with the most recent Final Plan Revision being approved on December 13, 2012 as PDFNL12.14, which consisted of adding forty-seven new parking spaces and the construction of a storage silo. Additional information on the legislative history of the property can be found in the attached Property Research Sheet.
With this Final Plan Revision, the Petitioner is proposing the construction to the east, south, and northeast of the building. There will be eighty-eight (88) passenger vehicle stalls added to the east of the building, and eighteen (18) passenger vehicle parking stalls added to the south of the building. A total of 106 parking stalls for passenger vehicle stalls will be added with this Final Plan Revision. To the northeast of the building, there will be nineteen parking stalls added for commercial trucks. The areas where the passenger vehicle parking will be added are being extended from areas where there is currently existing, similar parking. The area where the commercial truck parking is being added is grass, and is near existing loading docks.
DISCUSSION:
Staff has reviewed the Final Plan Revision petition and have sent comments back to the petitioner on those submittals. The petitioner has made the requested revisions to these documents and they now meet the applicable codes and ordinances, with the exceptions of the items reflected in the conditions listed in the Staff Recommendation below.
POLICIES AND GUIDELINES:
The Staff's Evaluation and Recommendation are based on the following Physical Development Policies:
41.1 (2): To promote a balanced distribution of industries within the City.
41.1 (8): To promote a quality environment through the enforcement of industrial
performance standards.
51.1 (3): To actively promote and pursue the retention of businesses and industries
presently located within the city of Aurora.
RECOMMENDATIONS:
The Planning Commission recommended CONDITIONAL APPROVAL of the Building, Zoning, and Economic Development Committee Resolution Approving a Revision to the Final Plan on Lot 201, Phase II, Unit 2-1 of the Butterfield Subdivision, located at 2759 North Eola Road, for a Warehouse, Distribution, and Storage Services (3300) Use, with the following conditions:
1) That all of the comments of the Engineering Department be addressed prior to approval of the Final Engineering plans.

WHEREAS, the City of Aurora has a population of more than 25,000 persons and is, therefore, a home rule unit under subsection (a) of Section 6 of Article VII of the Illinois Constitution of 1970; and
WHEREAS, subject to said Section, a home rule unit may exercise any power and perform any function pertaining to its government and affairs for the protection of the public health, safety, morals, and welfare; and
WHEREAS, by petition dated August 14, 2019, Liberty Property Trust, filed with the City of Aurora a petition Requesting Approval of a Final Plan Revision for Lot 201 of Butterfield Subdivision Phase II, Unit 2-1, located at 2759 N. Eola Road, for a Warehouse, Distribution and Storage Services (3300) Use and related required documents as attached hereto as Exhibits "A-1" through Exhibit “A-2”; and
WHEREAS, after referral of said petition from the Aurora City Council, the Aurora Planning Commission, on September 4, 2019, reviewed the petition and recommended CONDITIONAL APPROVAL of said petition; and
WHEREAS, on September 11, 2019,, the Building, Zoning and Economic Development Committee of the Aurora City Council reviewed said Final Plan Revision and the before mentioned recommendations and recommended CONDITIONAL APPROVAL of said petition; and
WHEREAS, the decision of the Building, Zoning and Economic Development Committee with respect to a final plan is subject to appeal to the City Council in the manner set forth in the City of Aurora Zoning Ordinance; and
WHEREAS, no person authorized under City of Aurora Zoning Ordinance to appeal such decision having done so in the manner set forth in the Ordinance, the Decision of the Building, Zoning and Economic Development Committee constitutes final action on the proposed final plan; and
NOW, THEREFORE, BE IT RESOLVED that the Building, Zoning and Economic Development Committee of the City of Aurora, Illinois, finds as facts all of the preamble recitals of this Resolution and hereby grants CONDITIONAL APPROVAL of said Final Plan with the following conditions:
1) That all of the comments of the Engineering Department be addressed prior to approval of the Final Engineering plans.
BE IT FURTHER RESOLVED that the Building, Zoning and Economic Development Committee of the City of Aurora hereby adopts the Final Plan and related required documents, as attached hereto as Exhibit "A-1" Final Plan, Exhibit “A-2” Landscape Plan, along with any easement dedications or vacations deemed necessary by the Aurora City Engineer.
