SUBJECT:

Resolution Authorizing the Mayor and City Clerk to execute the warranty deeds to convey properties owned by the City to the Illinois State Toll Highway Authority associated with the construction of the Eola and I-88 Tollway Interchange- Ward 10/Lofchie.

 

PURPOSE:

To authorize the Mayor and City Clerk to execute the warranty deeds to convey properties owned by the City to the Illinois State Toll Highway Authority associated with the construction of the Eola and I-88 Tollway Interchange.

 

BACKGROUND:

On December 16, 2008, the City entered into an intergovernmental agreement (IGA) between DuPage County and the Illinois State Toll Highway Authority for the construction of an interchange at Eola Road and Ronald Reagan Memorial Tollway (I-88).   The project consisted of the construction of ramps connecting I-88 to Diehl Road and Bilter Road. Ramp A is the exiting ramp to Bilter Road, Ramp B is the eastbound entrance ramp to I-88 from Diehl Road, Ramp C is the eastbound exit ramp from I-88 to Diehl Road, and Ramp D is the westbound entrance ramp to I-88 from Bilter Road.  The project also included roadway widening and resurfacing of Eola Road, Diehl Road, and Bilter Road, construction of new storm drainage and stormwater facilities, installation of streetlights and traffic signals, and relocation of the existing Illinois Prairie path and existing utilities.

 

Under the terms of the IGA, the City was responsible to secure the right of way necessary for the construction of the project.  The City acquired the following properties; Parcel E-IC-01-001 & 001.01 (Resolution R2009-008075), Parcel E-1C-01-019 (Resolution R2006-226447, Parcel E-1C-01-003 (Resolution 2008-436), Parcel E-1C-01-029 (Resolution 2007-144991), and Parcel 1C-01-020.   Please see attached “Exhibit A and Project Location Exhibit” for reference. 

 

Dupage County was responsible for acquiring the remaining ROW and contributed funds toward the project.  The Illinois State Toll Highway Authority managed the engineering design and construction of the project and provided 50% of the construction costs.

 

Construction began in August of 2008 and Eola Interchange was open to traffic in November 2009.

 

The warranty deeds were prepared by Illinois State Highway Authority and have been reviewed by the City.

 

DISCUSSION:

The conveyance of these properties is required per the IGA.  The Illinois State Toll Highway Authority desire to obtain the properties associated with the I88 and Eola Rd Interchange.

 

IMPACT STATEMENT:

There is no impact, the properties will be transferred to the Illinois State Toll Highway Authority for continuous maintenance.

 

RECOMMENDATIONS:

Please forward this resolution to the Finance Committee for their review and recommendation for approval.

WHEREAS, the City of Aurora has a population of more than 25,000 persons and is, therefore, a home rule unit under subsection (a) of Section 6 of Article VII of the Illinois Constitution of 1970; and

 

WHEREAS, subject to said Section, a home rule unit may exercise any power and perform any function pertaining to its government and affairs for the protection of the public health, safety, morals, and welfare; and

 

WHEREAS, the City of Aurora entered into an Intergovernmental agreement (IGA) with the  DuPage County and Illinois State Toll Highway Authority per Resolution R08-580 for the construction of the Eola Road and I-88 Tollway Interchange; and

 

WHEREAS, in accordance with the agreement, the Toll Highway Authority shall be responsible for construction and maintenance of the Eola Interchange and the City of Aurora was responsible for securing the Right of Way necessary for the project; and

 

WHEREAS, construction began in August of 2008 and the project was completed and open to traffic in November of 2009, referred to “Exhibit A- Project Location & Plat of Highway”; and

 

WHEREAS, the Toll Highway Authority desires to obtain certain properties own by the City of Aurora associated with the Eola Rd Interchange and has prepared these warranty deeds.  The City has reviewed these warranty deeds, hereby referred as “Exhibit B-Warranty Deed" for the properties and shall convey said properties to the Illinois State Toll Highway Authority; and

 

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Aurora, Illinois, as follows: that the Mayor and City Clerk are hereby authorized to execute the attach warranty deeds as set forth in “Exhibit B Warranty Deed” associated with the construction of Eola Road and I-88 Interchange Project.
