SUBJECT:
An Ordinance Amending Ordinance Number 3100, being the Aurora Zoning Ordinance and the Zoning Map attached thereto, by Rezoning Property located at 1923 Bilter Road from ORI(S) to PDD Planned Development District and Granting a Variance to Parking Stall Width (WDS Real Estate, Inc. / Chicago Premium Outlets / Rezoning - 14-00694 / AU01/2-14.221-Rz/Fsd/Fpn - ES - Ward 1)  (PUBLIC HEARING)     
 
PURPOSE:
The Petitioner, WDS Real Estate, Inc. / Chicago Premium Outlets, is proposing a Rezoning Petition rezoning property from ORI(S) to PDD and a Variance Petition for the construction of a parking lot with 349 spaces along with detention and storm sewer located at 1923 Bilter Road.   
 
BACKGROUND:
This Rezoning and Variance petition was referred by the City Council to the Planning & Zoning Division on August 19, 2014.  The petition was unanimously moved forward by the Planning Council on September 2, 2014.  
 
DISCUSSION:
The proposal consists of expanding the exisitng Chicago Premium Outlet (CPO) mall onto the Subject Property.  The Subject Property is proposed to be rezoned from ORI(S) to PDD within Parcel 2A Commercial of the Farnsworth International Plan Description, in order to match the existing outlet mall's zoning and requirements.
 
This property has been used by Western Dupage Landscaping.  The property will be razed.  The rezoning is to allow for a 349 vehicle parking lot with stormwater detention to be added to the existing mall.  An accompanying Final Plan and Plat shows this plan in detail.  A Variance is also included in this petition to allow 8.5 foot parking stall widths as was done in the rest of the mall to maximize parking.  Overall parking will increase to approximately 4,441 spaces, for an overall parking ratio of 1 space per 165 square foot of gross floor area, and improvement from the current 1/179 ratio and better than the required 1/200 in the AZO.
 
Staff has not received any public input on this petition.  
 
IMPACT STATEMENT:
The Planning and Zoning Division would anticipate that this project will increase the City's overall tax base and viability by facilitating investment and development.   
 
RECOMMENDATIONS:
Staff recommends APPROVAL of the Rezoning and Variance Petition at 1923 Bilter Road to allow for construction of a 349 space parking lot."

WHEREAS, the City of Aurora has a population of more than 25,000 persons and is, therefore, a home rule unit under subsection (a) of Section 6 of Article VII of the Illinois Constitution of 1970; and
 
WHEREAS, subject to said Section, a home rule unit may exercise any power and perform any function pertaining to its government and affairs for the protection of the public health, safety, morals, and welfare; and
 
WHEREAS, WDS Real Estate, Inc. is the owner of record of the real estate property legally described on Exhibit "A", attached hereto and incorporated herein by reference as if fully set forth; and
 
WHEREAS, WDS Real Estate, Inc.  filed a Rezoning/Variance petition with the City of Aurora on August 19, 2014, to amend Ordinance Number 3100, being the Aurora Zoning Ordinance and the Zoning Map attached thereto, to rezone the property legally described on said Exhibit "A" from ORI(S) to PDD and to vary the parking stall width to 8.5 feet; and
 
WHEREAS, after referral of said petition from the Aurora City Council, and after due notice and publication of said notice, the Aurora Planning Commission conducted a public hearing on September 3, 2014, with respect to said petition for Rezoning/Variance and made their requisite findings of fact as prescribed by Section 11.5-6 Findings of fact and recommendation of the Planning Commission of said Ordinance Number 3100, and recommended Approval of said petition to the Aurora City Council.
 
WHEREAS, on September 11, 2014, the Planning and Development Committee of the Aurora City Council reviewed said Rezoning/Variance and the before mentioned recommendations and recommended Approval of said petition; and
 
NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Aurora, Illinois, Section One: That said City Council of the City of Aurora, Illinois finds as fact all of the preamble recitals of this Ordinance.
 
Section Two: That Ordinance Number 3100, being the Aurora Zoning Ordinance and the Zoning Map attached thereto be, and the same are, hereby amended to rezone the real estate property described in Exhibit "A", attached hereto and incorporated herein by reference as if fully set forth and hereinafter referred to as said Exhibit "A" and depicted in Exhibit "B", being the plan(s), from ORI(S) to PDD Planned Development District, Parcel 2A of the Farnsworth International Plan Description, Being Ordinance Number O89-040,
 
Section Three: That the property described on Exhibit "A" is hereby granted the following variation from the standards of Ordinance No. 3100, Section 5.13-3.2.1 Parking Stalls, of the Aurora Zoning Ordinance:
 
      1.  Eight and one half (8 1/2') parking stall width.
 
Section Four: That this Ordinance shall be in full force and effect, and shall be controlling, upon its passage and approval.
 
Section Five: That all Ordinances or parts of Ordinances in conflict herewith are hereby repealed insofar as any conflict exists.
 
Section Six: That any section, phrase or paragraph of this Ordinance that is construed to be invalid, void or unconstitutional shall not affect the remaining sections, phrases or paragraphs of this Ordinance which shall remain in full force and effect.
