A Resolution for Acceptance of Improvements and Maintenance Security for Deerpath Commerce Center - COA Case No. 15.088 
 
PURPOSE:
To accept the Mass Grading and Public Improvements and Maintenance Security for Deerpath Commerce Center
 
BACKGROUND:
This development has completed all Mass Grading, installations, inspections and submissions of the public improvements that make it eligible to be recommended for final acceptance of those improvements.
 
DISCUSSION:
The Subdivision Control Ordinance, upon the acceptance of the improvements by City Council, requires the posting of a security for a one year maintenance period.
 
IMPACT STATEMENT:
This action may add new public infrastructure /utilities to various divisions for maintenance, including streets, water, storm, sanitary, electrical, storm water management, fiber optic.
 
RECOMMENDATIONS:
Approve the acceptance of the Mass Grading and improvements and Maintenance Security for Deerpath Commerce Center

A Resolution for accepting the Mass Grading, Improvements and Maintenance Security for Deerpath Commerce Center - 2570 Orchard-Gateway Rd.

WHEREAS, the City of Aurora has a population of more than 25,000 persons and is, therefore, a home rule unit under subsection (a) of Section 6 of Article VII of the Illinois Constitution of 1970; and
 
WHEREAS, subject to said Section, a home rule unit may exercise any power and perform any function pertaining to its government and affairs for the protection of the public health, safety, morals, and welfare; and
 
WHEREAS, Conor Deerpath LLC, has completed the Mass Grading, and Public Improvements for said project; and
 
WHEREAS, these said improvements have been inspected during construction by the Engineering Department, or their authorized representative, and were found to be in substantial conformance with the approved plans; and
 
WHEREAS, the City Engineer has recommended acceptance of the Mass Grading and  Improvements upon posting of a Maintenance Security in the amount of $214,694.00.
 
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Aurora, Illinois, as follows: that the acceptance of the Mass Grading and Improvements be approved upon receipt of a Maintenance Security in the amount of $214,694.00.
