A Resolution to authorize the City of Aurora to enter into a new Commercial Lease Agreement with Peter Lo Destro, 17 B Ashe Road, Sugar Grove, IL, 60554, d/b/a Jumpin Java Coffee, for commercial space at the Aurora Transportation Center Located at 233 N Broadway, Aurora Illinois 60505 commonly known as “ATC”.
PURPOSE:
Resolution authorizing the City of Aurora to enter into a new Commercial Lease Agreement with Jumpin Java for the use of a commercial space at the ATC.
BACKGROUND:
The City originally entered into a lease agreement with Peter Lo Destro back in 2006 for the operation of a coffee shop inside of the ATC building. The most recent lease amendments were executed, which allowed an extension of the previous lease. Jumping Java is currently occupying approximately 423 sq. ft. and operating in a commercial space at the ATC.
DISCUSSION:
Approving a new commercial lease would allow Mr. Lo Destro to continue his operation of the coffee shop. The new lease agreement would also continue the City’s efforts to standardize our Commercial Leases. Rent for the lease agreement would be $225 per month. In addition, a security deposit of $225 will be paid at the execution of this new lease agreement.
IMPACT STATEMENT:
The approval of this commercial lease agreement would allow for Mr. Lo Destro to continue his operation in a space that would otherwise become vacant.
RECOMMENDATIONS:
To approve entering into a new Commercial Lease Agreement with Mr. Lo Destro for the use of the commercial space at the ATC.

WHEREAS, the City of Aurora has a population of more than 25,000 persons and is, therefore, a home rule unit under subsection (a) of Section 6 of Article VII of the Illinois Constitution of 1970; and
WHEREAS, subject to said Section, a home rule unit may exercise any power and perform any function pertaining to its government and affairs for the protection of the public health, safety, morals, and welfare; and
WHEREAS, Jumpin Java has been operating the coffee shop in the commercial space located at the ATC; and
WHEREAS, Mr. Lo Destro plans to continue his operation of the coffee shop in the current space. The monthly rent for this space is $225.
WHEREAS, Jumpin Java had been allowed to continue their operations while lease negotiations were on-going. This agreed upon lease will be effective beginning on March 1st, 2015.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Aurora, Illinois, as follows: the Commercial Lease Agreement with Jumpin Java for the use of the commercial space located at the ATC is hereby approved.
