Ordinance authorizing the sale of the west 33 1/2 feet of City real estate (Lot 13), located at 800 Superior Street, Aurora, Illinois, Permanent Index No.: 15-23-178-013
PURPOSE:
Attached is an Ordinance authorizing the sale of the easterly thirty-three and one-half feet (33 1/2') of City real estate, Lot 3, commonly known as 800 Superior Street, with PIN 15-23-178-013, to Gloria Lopez, who owns the property directly east of the area to be sold (804 Superior Street). Under the terms of the proposed sale, Lopez will pay the City one dollar ($1.00) and consolidate the land with her current parcel. This sale includes all said property PIN 15-21-178-013.
BACKGROUND:
The City was granted the parcel at 800 Superior Street, Aurora, Illinois by the Kane County Sheriff in October 2005. The property is currently exempt from real estate taxes. The lot is to be given to the adjoining land owner (Lopez) as legally described below:
THE WEST 33 1/2 FEET OF THE SOUTHERLY 55 2/3 FEET OF LOT 3 IN BLOCK 8 IN BEACH & SHEDD'S ADDITION TO AURORA, IN THE CITY OF AURORA, KANE COUNTY, ILLINOIS, COMMONLY KNOWN AS 800 SUPERIOR STREET, AURORA, ILLINOIS 60505.
DISCUSSION:
The City has made this type of arrangement before with adjacent owners in order to dispose of vacant City-owned lots.
IMPACT STATEMENT:
Transfer of the property to the adjoining property owner will move parcel back onto the City tax rolls and remove parcel from City maintenance.
RECOMMENDATIONS:
Place of Finance Committee Calendar (6/13/17 Agenda) for approval to City Council.

WHEREAS, the City of Aurora has a population of more than 25,000 persons and is, therefore, a home rule unit under subsection (a) of Section 6 of Article VII of the Illinois Constitution of 1970; and
WHEREAS, subject to said Section, a home rule unit may exercise any power and perform any function pertaining to its government and affairs for the protection of the public health, safety, morals, and welfare; and
WHEREAS, the City of Aurora is interested in selling and Gloria Lopez in interested in purchasing real estate known as the West 33 1/2 feet of the Southerly 55 2/3 feet of Lot 3 in Block 8 in Beach & Shedd's Addition to Aurora, in the City of Aurora, Illinois with PIN 15-23-178-013 ("Property") in accordance with the terms and restrictive covenant set forth in the attached Agreement.
NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Aurora, Illinois, as follows: that the attached Agreement for the sale of the West 33 1/2 feet of the Southerly 55 2/3 feet of lot 3 in Beach & Shedd's Addition to Aurora, in the City of Aurora, Illinois for the sum of $1.00 is hereby approved. Additionally, Chuck Nelson is hereby authorized to act on the City's behalf to complete the sale of these properties.
