SUBJECT:

Resolution Authorizing the City of Aurora to Enter into a Residential Lease Agreement for 817 Forest Avenue.

 

PURPOSE:

To obtain City Council approval to enter into a new two year residential lease agreement through August 31, 2017 for city-owned property located at 817 Forest Avenue, Aurora, IL.

 

BACKGROUND:

The Parks & Recreation Division has leased the city-owned property at 817 Forest Avenue to various City employees for almost 40 years in order to preserve our residential asset and ensure regular oversight of adjacent Garfield Park.  Denise Hakala has been the tenant since April of 2011. 

 

Historically, the employee tenants have been required to perform duties typically not associated when renting residential property. These duties include: reporting of ordinance violations and maintenance issues at the park; opening and closing bathroom facilities and parking lot gates; managing concessions at Garfield and Solfisburg parks; and advising park users when the park is closed. In exchange for these services the tenants pay below market rental rates.

 

DISCUSSION:

The estimated current market rent for this residential property is $1,000.00 per month.  The current lessee, Denise Hakala, will continue to assume the duties she previously performed.  The monthly rent is being increased by 5% from $500.00 per month to $525.00 per month.  This lease term is for two years through August 31, 2017 after which time becomes a month to month lease with annual rent increases of 3%.  In addition, there is a 60 day termination clause which provides both the City and tenant the flexibility to end the lease at any time for any reason with proper notice.

 

 

IMPACT STATEMENT:

This agreement will generate revenue and provide cost savings on multiple fronts while preserving the City’s asset. It will also provide oversight of seasonal city staff that are providing concessions at the City’s ball fields.

 

RECOMMENDATIONS:

In the interest of preserving this residential asset and to have a City employee keep a watchful eye on 817 Forest Avenue, Garfield Park and the concessions at both Garfield and Solfisburg Park ball fields, I am recommending the City Council approve this residential lease agreement.

WHEREAS, the City of Aurora has a population of more than 25,000 persons and is, therefore, a home rule unit under subsection (a) of Section 6 of Article VII of the Illinois Constitution of 1970; and

 

WHEREAS, subject to said Section, a home rule unit may exercise any power and perform any function pertaining to its government and affairs for the protection of the public health, safety, morals, and welfare; and

 

WHEREAS, the City of Aurora has previously leased the property located at 817 Forest Avenue to city employees for almost 40 years in order to preserve our residential asset and ensure regular oversight of the adjoining Garfield Park; and

 

WHEREAS, Denise Hakala, city employee, has agreed to assume such duties historically performed by previous tenants, and she will also manage after hours concessions operated by seasonal city staff at Solfisburg and Garfield Parks, all as set forth in the attached lease agreement.

 

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Aurora, Illinois, as follows: hereby approves and authorizes the Mayor to execute the attached lease between the City of Aurora and Denise Hakala for 817 Forest Avenue, Aurora, IL.
