Resolution Authorizing an Amendment to a 2014 CDBG Subrecipient Agreement for Visiting Nurses Association Healthcare, Inc. (VNA), to Allow for the Completion of a Demonstration Kitchen and Classroom  
 
PURPOSE:
In December of 2014, VNA requested an amendment under its 2014 Community Development Block Grant (CDBG) funding agreement for the completion of a demonstration Kitchen and multi-purpose classroom (attached).  Specifically, the VNA seeks to reallocate hard construction costs between line items, as some costs came in above, and some below, original budget estimates.  The Amendment (also attached) reallocates $11,862.00 between construction cost line items, allowing for a complete pay-out on the project.  This Amendment does not change the overall CDBG award for the kitchen/classroom project, which was $210,000.
 
BACKGROUND:
The Subrecipient Agreement for VNA was one of ten projects funded with a 2014 CDBG allocation that was approved by the City Council with Resolution R14-019 on 11 February 2014.
 
DISCUSSION:
The City's 2014 CDBG Subrecipient Agreements can only be amended with the consent of the City Council. This Amendment to a 2014 Subrecipient Agreement with VNA does not increase its budget allocation, but allows the Agency to complete the project.
 
IMPACT STATEMENT:
There is no additional cost of staff impacts to this request.
 
RECOMMENDATIONS:
That the City Council approve a Resolution authorizing the attached Amendment with VNA that reallocates project costs for a demonstration kitchen and multi-purpose classroom project and authorize the City's Neighborhood Redevelopment Manager to execute the Amendment and any required additional documents related to this approval.

WHEREAS, the City of Aurora has a population of more than 25,000 persons and is, therefore, a home rule unit under subsection (a) of Section 6 of Article VII of the Illinois Constitution of 1970; and
 
WHEREAS, subject to said Section, a home rule unit may exercise any power and perform any function pertaining to its government and affairs for the protection of the public health, safety, morals, and welfare; and
 
WHEREAS, The City of Aurora has initiated numerous community development and housing activities through funding by the U.S. Department of Housing and Urban Development; and
 
WHEREAS, the City of Aurora has a Consolidated Plan and Annual Action Plan which have been adopted by the City Council and which define priorities for federal funding; and
 
WHEREAS, the City of Aurora and VNA have previously agreed to a CDBG  Subrecipient Agreement for 2014 for the completion of a demonstration kitchen and multipurpose classroom, which both parties desire to now amend in order to allow VNA to reallocate construction costs within the Project,  but this amendment will  not increase the approved budget paid by the City through its CDBG funding.
 
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Aurora, Illinois, as follows: that the 2014 CDBG Subrecipient Agreement for the VNA Demonstration Kitchen and Multipurpose Classroom be amended to allow the reallocation of CDBG funded project costs within its budget with no increase in contribution by the City, and that the City's Neighborhood Redevelopment Manager and City Clerk are hereby authorized to execute any contracts or other documents pertaining to said reallocation of funds, and all other provisions of the 2014 Action Plan remain in full force and effect.
