SUBJECT:

An Ordinance Changing the Name of 4th Street to East 4th Street between Reid Place and Poss Road in DuPage County, Aurora Illinois (City of Aurora - 17-00568 / NA17/1-17.120-M- TV - Ward 10)  

 

PURPOSE:

The City of Aurora is requesting a street name change from 4th Street to East 4th Street between Reid Place and Poss Road.  

 

BACKGROUND:

There are nine properties along the west side of 4th Street between Reid Place and Poss Road which were annexed into the City of Aurora in 2001.

 

Since there was already a street name called "4th Street" within the City of Aurora, a street name change was to occur once the properties were annexed to "East 4th Street"; however, this name change was never completed. 

 

DISCUSSION:

Staff has reviewed the Street Name Change petition and have determined that it meets the applicable codes and ordinances. 

 

IMPACT STATEMENT :

The properties in this area are currently using East 4th Street, therefore, this street name change will not have any impact and will correct the County's records.  

 

RECOMMENDATIONS:

Staff would recommend APPROVAL of the Ordinance Changing the Name of 4th Street to East 4th Street between Reid Place and Poss Road in DuPage County, Aurora Illinois

An Ordinance Changing the Name of 4th Street to East 4th Street between Reid Place and Poss Road in DuPage County, Aurora Illinois

WHEREAS, the City of Aurora has a population of more than 25,000 persons and is, therefore, a home rule unit under subsection (a) of Section 6 of Article VII of the Illinois Constitution of 1970; and

 

WHEREAS, subject to said Section, a home rule unit may exercise any power and perform any function pertaining to its government and affairs for the protection of the public health, safety, morals, and welfare; and

 

WHEREAS, City of Aurora  desires, pursuant to Section 42-3 and 42-20 of Article I of Chapter 42 of the Aurora Code of Ordinance to change the name of a former portion of 4th Street to East 4th Street as hereinafter set forth;

 

NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Aurora, Illinois, as follows:

 

Section One: That the City Council of the City of Aurora, Illinois finds as fact all of the preamble recitals of this Ordinance.

 

Section Two: That this Ordinance shall be in full force and effect, and shall be controlling, upon its passage and approval.

 

Section Three: That all Ordinances or part of Ordinances in conflict herewith are hereby repealed insofar as any conflict exists. 

 

Section Four: That any section, phrase or paragraph of this Ordinance that is construed to be invalid, void or unconstitutional shall not affect the remaining sections, phrases or paragraphs of this Ordinance which shall remain in full force and effect.

 

Section Five: That the name of former 4th Street be and is hereby changed to East 4th Street, located within Section 17 of Naperville Township, DuPage County Illinois, all as shown on the plat map attached hereto as Exhibit “A”, and made a part hereof.

 

Section Six: That the City Clerk of the City of Aurora, Illinois, is hereby directed to forward a copy of this Ordinance after its passage and signing to the Director of Public Works so that the street sign may be changed, the Aurora Police Department / Communication - 911, and the Fire Marshall so that the name change may be noted on the “emergency response maps” and to the Zoning Administrator and the Planning Director so that the name change may be noted on the Official Zoning Maps of the City of Aurora, and record this Ordinance at the DuPage County Recorder’s office.
