A Resolution Approving a Final Plan on Lot 2A, Butterfield East, Unit 1 Resubdivision, Located at 2810 Duke Parkway, for a Business and Professional, Office (2400) Use and a Warehouse, Distribution and Storage Services (3300) Use. (Atlanta Land - ESI Design Services, Inc. - 23-0197 / WI33/3-23.126-FPN - SB - Ward 10)
PURPOSE:
The Petitioner, Atlanta Land - ESI Design Services, Inc., is requesting a Final Plan for Lot 2A of Butterfield East, Unit 1, Located at 2810 Duke Parkway for a Business and Professional, Office (2400) Use and a Warehouse, Distribution and Storage Services (3300) Use, which includes development of the Subject Property for an approximately four hundred, seven thousand (407,000) square foot building that will be utilized for food distribution.
BACKGROUND:
The Subject Property is currently zoned PDD, Planned Development District. The Subject Property is a vacant lot that is approximately fifty (50) acres that is in the Butterfield development district. The Comprehensive Plan designates the property as Office / Research / Light Industrial. The Subject Property is an Interior Lot that fronts on Duke Parkway.
The Petitioner, Atlanta Land - ESI Design Services, Inc, is requesting approval of a Final Plan for Lot 2A of Butterfield East, Unit 1, Located at 2810 Duke Parkway for a Business and Professional, Office (2400) Use and a Warehouse, Distribution and Storage Services (3300) Use. The details of the request include construction of an approximately four hundred, seven thousand (407,000) square foot building that will be utilized for food distribution. The minimum parking requirement is two hundred, forty-five (245) passenger vehicle parking spaces, and designated spaces for tractor trailer parking on the northern portion of the Subject Property. There is also an approximately seventeen thousand (17,000) maintenance building, which will perform accessory vehicle repair on the trucks. The proposed major vehicle repair is a permitted use in the Butterfield development district when the work is completed within the enclosed building. The Final Plan proposal also includes a new rail spur connection to the existing adjacent CN Railroad on the western side. There is also a proposed fire lane connection to the property to the southwest.
The Petitioner has also provided building elevations. The proposed building, at its peak, is approximately forty-four (44) feet tall from grade. The office portion of the building, which is located at the building’s northeast corner, consists of tastefully designed aluminum plank cladding, horizontally mounted gray metal panels, and windows that face towards Duke Parkway. The warehouse portion of the building consists of insulated metal panels, which are also tastefully designed.
Concurrently with this proposal, the Petitioner is requesting approval of a Plat of Vacation. The details of the request include the vacation of approximately two thousand, three hundred (2,300) square feet of Duke Parkway right-of-way. The right-of-way area that is being vacated is located on the eastern edge of the Subject Property where Duke Parkway bends slightly to the east.
Concurrently with this proposal, the Petitioner is requesting approval of a Plat of Dedication for right-of-way. The details of the request include the dedication of approximately four hundred (400) square feet for right-of-way. The right-of-way area that is being dedicated located on the eastern edge of the Subject Property, just north of where Duke Parkway bends slight to the east.
DISCUSSION:
Staff has reviewed the Final Plan Resolution petition and have sent comments back to the petitioner on those submittals. The Petitioner has made the requested revisions to these documents and they now meet the applicable codes and ordinances, with the exception of the items reflected in the conditions listed in the Staff Recommendation below.
POLICIES AND GUIDELINES:
The Staff’s Evaluation and Recommendation are based on the following Physical Development Policies:
41.1 (1): To encourage the location of industrial, office and office-research development
near transportation facilities designed to provide adequate and efficient linkages
to sources of labor, production materials and markets.
41.1 (2): To promote a balanced distribution of industries within the City.
41.1 (6): To promote attractive, well-maintained industrial and office-research areas
through landscaping and site design.
RECOMMENDATIONS:
Staff would recommend CONDITIONAL APPROVAL of the resolution approving a Final Plan on Lot 2A, Butterfield East, Unit 1 Resubdivision, Located at 2810 Duke Parkway, for a Business and Professional, Office (2400) use and a Warehouse, Distribution and Storage Services (3300) use, with the following conditions:
1) That, prior to final occupancy being issued, the necessary emergency access routes be established for the Subject Property.

WHEREAS, the City of Aurora has a population of more than 25,000 persons and is, therefore, a home rule unit under subsection (a) of Section 6 of Article VII of the Illinois Constitution of 1970; and
WHEREAS, subject to said Section, a home rule unit may exercise any power and perform any function pertaining to its government and affairs for the protection of the public health, safety, morals, and welfare; and
WHEREAS, petition dated March 2, 2023, Atlanta Land - ESI Design Services, Inc. filed with the City of Aurora a petition Requesting a Final Plan for Lot 2A of Butterfield East, Unit 1, Located at 2810 Duke Parkway for a Business and Professional, Office (2400) Use and a Warehouse, Distribution and Storage Services (3300) Use. and related required documents as attached hereto as Exhibits "A-1" through Exhibit “A-3”; and
WHEREAS, on April 26, 2023, the Building, Zoning and Economic Development Committee of the Aurora City Council reviewed said Final Plan and recommended CONDITIONAL APPROVAL of said petition; and
WHEREAS, the decision of the Building, Zoning and Economic Development Committee with respect to a Final Plan is subject to appeal to the City Council in the manner set forth in Chapter 34 of the Code of Ordinances, City of Aurora, Illinois; and
WHEREAS, no person authorized under Chapter 34 to appeal such decision having done so in the manner set forth in the Code, the Decision of the Building, Zoning and Economic Development Committee constitutes final action on the proposed Final Plan; and
NOW, THEREFORE, BE IT RESOLVED that the Building, Zoning and Economic Development Committee of the City of Aurora, Illinois, finds as fact all of the preamble recitals of this Resolution and hereby grants CONDITIONAL APPROVAL of said Final Plan with the following conditions:
1) That, prior to final occupancy being issued, the necessary emergency access routes be established for the Subject Property.
BE IT FURTHER RESOLVED that the Building, Zoning and Economic Development Committee of the City of Aurora hereby adopts the Final Plan and related required documents, as attached hereto as Exhibit "A-1" Final Plan, Exhibit “A-2” Landscape Plan, and Exhibit “A-3” Building and Signage Elevations, along with any easement dedications deemed necessary by the Aurora City Engineer.
