SUBJECT:

Resolution Authorizing the Mayor and City Clerk to Enter into a Construction and Financing Agreement with Farnswood Condominium Association for Drainage and Storm Sewer Improvements.

 

PURPOSE:

To obtain authorization to enter a construction and financing agreement with Farnswood Condominium Association for drainage and storm sewer improvements in Farnswood Subdivision.

 

BACKGROUND:

Farnswood Subdivision is located north of Reckinger Road and McClure Road. (Refer to project location map).  The subdivision was platted in the early 1970’s prior to modern stormwater management.  The subdivision and surrounding roadway experiences chronic flooding when the existing on site and roadway storm sewer systems are overwhelmed during storm events.

 

Residents have had water in their garages and homes, most recently occurring on June 15, 2015. McClure Road has to be temporary closed due to standing water, restricting residents and emergency vehicles access.

 

 

DISCUSSION:

Farnswood Condominium Association and City staffs have both reviewed the proposed agreement, attached as exhibit "A", Drainage Improvements and Financing Agreement.  Both parties agreed that the purpose of this agreement is to ensure financial commitment for proposed construction. The Farnswood Condominium Association has granted easements to the City for this project. 

 

In order to address the flooding in the area and reduce the risk of flooding during storm events, the City and the Farnswood Condominium Association proposes the following drainage and storm sewer improvements:

 

- Construction of an open channel and storm sewer downstream of Avati Lane and Perry Court and south of Reckinger Road.

-Reconstruct of Perry Court and Avati Lane and installation of trench drain to redirect runoff to the west and to the proposed open channel and storm sewer system.

-Construction of a new storm sewer along the west side of McClure Road, which is designed to convey the 100 year storm event.

-Construction of a channel south of Reckinger Rd along the west side of the Fox Valley Park District property to the City owner pond at the north east corner of Indian Trail and Farnsworth Avenue.

 

All work on Farnswood Condominium property will be reimbursed to the City from the Association

 

The estimated total construction cost is $606,343.00, as prepared by the City’s consultant, attached as Exhibit "B".  The total estimated cost for the Farnswood Condominium Association portion (phase 2) is $340,888.00 and City portion (phase 1) $265,455.00.  The 2016 CIP B049 provides funding from account No. 280-1852-512-81-90 for this improvements. Final engineering plan and bid specification are being finalized.  Construction is tentatively schedule for summer of 2016.

 

IMPACT STATEMENT:

Funding provided for in CIP B049. Minimal impact to residents during construction.

 

RECOMMENDATIONS:

Please forward this resolution to the Finance Committee for their review and recommendation for approval of this agreement.

WHEREAS, the City of Aurora has a population of more than 25,000 persons and is, therefore, a home rule unit under subsection (a) of Section 6 of Article VII of the Illinois Constitution of 1970; and

 

WHEREAS, subject to said Section, a home rule unit may exercise any power and perform any function pertaining to its government and affairs for the protection of the public health, safety, morals, and welfare; and

 

WHEREAS, (Farnswood Subdivision, located north of Reckinger Road, near McClure Road experiences chronic flooding when the existing on site and roadway storm sewer systems are overwhelmed during storm events; and

 

WHEREAS, the City has proposed a drainage improvement to address the flooding in this area and to significantly improve flood protection during storm events; and

 

WHEREAS, the City and the Farnswood Condominium Association have drafted the attached  Construction and Financing Agreement, attached hereto as Exhibit “A” and made a part hereof; and

 

 WHEREAS, the City has contracted with Engineering Enterprises Inc. (EEI) to design a drainage improvement to reduce the risk of flooding herein, referred to as “ Overall Site Plan” which is depicted in the engineering plans attached as Exhibit "B"; and

 

WHEREAS, the City shall publicly bid the Project and execute a contract with a contractor to complete the Project; and

 

WHEREAS, the City has estimated the cost of construction to be a total sum of $606,343.00 for the project as identified on the engineer’s estimates prepared by Engineering Enterprises Inc., attached hereto as Exhibit “C” (“the Estimated Costs”) and incorporated herein; and

 

WHEREAS, the City has separated the plans and the cost estimate into two (2) phases.  Phase 1 will be the City’s cost, estimated cost being $265,455.00,and Phase 2 will be the Farnswood Condominium Association's cost, estimated cost being $340,888.00, to reach the total estimated cost of $606,343.00; and

 

WHEREAS, the Farnswood Condominium Association has executed a plat of easement to allow the City’s contractor to access the Farnswood Condominium property to construct the improvements of the Project; and  

 

WHEREAS, funding for the engineering services has been provided for in the 2016 budget BO49- Stormwater Facility Maintenance and Improvements Account No. 280-1852-512-81-90

 

 

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Aurora, Illinois, as follows: that the Construction and Financing Agreement attached hereto as Exhibit “A” is hereby approved, with the Mayor and City Clerk being hereby authorized to sign all documents in conjunction with said Project.
