A Resolution for Acceptance of Improvements and Waiving the Maintenance Security for Aurora Corporate Center Public Sidewalk for Lots 2, 3, & 5 - Ward 1.
PURPOSE:
To accept the Public Improvements and Waive the Maintenance Security for Aurora Corporate Center Public Sidewalk for Lots 2, 3, & 5.
BACKGROUND:
This development has completed all installations, inspections and submissions of the public improvements that make it eligible to be recommended for final acceptance of those improvements.
DISCUSSION:
The Subdivision Control Ordinance, upon the acceptance of the improvements by City Council, normally requires the posting of a security for a one year maintenance period. Due to the length of time that has passed since these improvements were installed, we are recommending waiving the normally required maintenance security and period.
IMPACT STATEMENT:
This action may add new public infrastructure /utilities to various divisions for maintenance, including streets, water, storm, sanitary, electrical, storm water management, fiber optic..
RECOMMENDATIONS:
Approve the acceptance of improvements and waiving of the normally required maintenance security and period for Aurora Corporate Center Public Sidewalk for Lots 2, 3, & 5.

WHEREAS, the City of Aurora has a population of more than 25,000 persons and is, therefore, a home rule unit under subsection (a) of Section 6 of Article VII of the Illinois Constitution of 1970; and
WHEREAS, subject to said Section, a home rule unit may exercise any power and perform any function pertaining to its government and affairs for the protection of the public health, safety, morals, and welfare; and
WHEREAS, Burgess Enterprises, L.P. has completed the public improvements for said project; and
WHEREAS, these said improvements have been inspected during construction by the Engineering Department, or their authorized representative, and were found to be in substantial conformance with the approved plans; and
WHEREAS, due to the length of time that has passed since these improvements were installed the City Engineer has recommended acceptance of the improvements and waiving the normally required maintenance security and period;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Aurora, Illinois, as follows: that the acceptance of the improvements be approved and that the normally required maintenance security and period be waived.
