SUBJECT:

A Resolution Authorizing the Director of Purchasing to Execute the Engineering Services Agreement with Santacruz Land Acquisitions and to Appropriate Motor Fuel Tax Funds for the East New York Street - Segment III (Farnsworth Avenue to Welsh Drive) Project, Section 14-00210-02-PV.

 

PURPOSE:

This is a Resolution to Approve the above referenced Engineering Services Agreement and to Appropriate Motor Fuel Tax (MFT) funds as required by the Illinois Highway Code.

 

BACKGROUND:

The City has received federal Surface Transportation Program (STP) funding in the maximum allowable amount of $2.5 million through the Kane Kendall Council of Mayors (KKCOM) for the East New York Street - Segment III (Farnsworth Avenue to Welsh Drive) project. The City also received $428,680 of Congestion Mitigation and Air Quality (CMAQ) funding for the construction of a bike path on this portion of E New York Street.  The City continues to seek additional funding for construction by applying for the STP - Shared Funds.  This is a new program implemented by the Chicago Metropolitan Agency for Planning (CMAP).

 

The City continues to work with their consultant, HR Green, on design plans under an agreement approved in 2014.  The plans are 90% complete and the project is targeting a summer 2020 IDOT letting with construction to begin in the fall of 2020 and completion by 2022.

 

During design, it was determined that twenty (20) parcels required additional right-of-way, permanent easement and/or temporary easements to construct the improvements.  The plat of highways were approved by IDOT on January 23, 2019.  In March 2019 the City approved an agreement with Civiltech Engineering, Inc. to provide appraisal and review appraisal services (R19-106).  At this time, the City is prepared to retain the services of a negotiator for each of the identified properties.  The current number of parcels needed for acquisition is nineteen (19).  The current overall plat of highway map is provided as ‘Exhibit C’.

 

DISCUSSION:

When Federal funds are utilized for construction, Negotiation Services must be performed by IDOT approved Consultants. The land acquisition consultants charge approximately the same amount for these types of services.  Each parcel cost may vary slightly depending on the site characteristics and complexity of the land acquisition. The engineering services agreement from Santacruz Land Acquisitions, in an amount not to exceed $62,700.00, is attached as Exhibit ‘A’. Santacruz Land Acquisitions has provided land acquisition services on a number of recent federally funded projects within the City including the Farnsworth Avenue Bridge, Sheffer Road Bridge, Ohio Street Bridge, and the Aurora Transportation Center (ATC) and Regional Enhancement Project.  They are able to complete the work in a timely manner to keep the project on schedule. 

 

With the use of MFT funds for the project, the local preference policy does not apply.

 

IDOT requires a Resolution to Appropriate the MFT funds prior to their expenditure for approved projects.  The Resolution for Improvement - BLR 09110 (Exhibit ‘B’) appropriating MFT funds in the amount of $62,700.00 is attached.  The 2019 City Budget will provide $62,700.00 for this item in Account 203-4460-431.79-59 (Motor Fuel Tax Fund).

WHEREAS, the City of Aurora has a population of more than 25,000 persons and is, therefore, a home rule unit under subsection (a) of Section 6 of Article VII of the Illinois Constitution of 1970; and

 

WHEREAS, subject to said Section, a home rule unit may exercise any power and perform any function pertaining to its government and affairs for the protection of the public health, safety, morals, and welfare; and

 

WHEREAS, it is necessary and desirable to retain a qualified engineering firm to complete the negotiation services, and

 

WHEREAS, there is a need for an engineering agreement with Santacruz Land Acquisitions of 222 Northfield Road - Suite 201, Northfield, IL  60093 to complete the negotiations for a total cost not to exceed $62,700.00 a copy of which agreement is attached hereto and incorporated herein as Exhibit 'A', and

 

WHEREAS, there is a need to appropriate Motor Fuel Tax funds for this agreement in the amount of $62,700.00, a copy of which resolution is attached hereto and incorporated herein as Exhibit 'B', and

 

WHEREAS, the 2019 City Budget provides $62,700.00 for this item in Account 203-4460-431.79-59 (Motor Fuel Tax Fund); and

 

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Aurora, Illinois, as follows: that the Director of Purchasing is hereby authorized to execute the Engineering Agreement as set forth in Exhibit 'A' and the City Clerk is hereby authorized to sign the Resolution for Improvement Under the Illinois Highway Code as set forth in Exhibit 'B'.
