SUBJECT:

A Resolution Approving a Final Plan on Condo Lot 4 of Lot 5 of Aurora Corporate Center Subdivision and Granting a Setback Variance for property located along the east side of Beverly Drive, south of Ginger Woods Parkway, Aurora, Illinois, 60502  (Aurora Corporate Center Development Company - L15-00409 / AU01/2-15.024-Fpn/V - TV - Ward 1)  

 

PURPOSE:

The Petitioner, Aurora Corporate Center Development Company is requesting approval of a Final Plan with a setback variance on 2.318, being Condo Lot 4 of Lot 5, in the Aurora Corporate Center which includes construction of 38,626 square foot multi-tenant contractor building.  

 

BACKGROUND:

The Subject Property is generally located along the east side of Beverly Drive, south of Ginger Woods Parkway and is currently vacant property with PDD Planned Development District zoning, which is part of the Farnsworth International Special Use Planned Development.  The Aurora Corporate Subdivision was approved in 2000.  The Subject Property was designated as Lot 5.  Then in 2008, a Condominium Plat for Lot 5 was recorded creating 4 condo lots.

 

The details of the proposal includes the construction of a 38,626 square foot multi-tenant contractor building on Condo Lot 4 with 10 truck doors on the north side of the building. There will be a total of 103 automobile parking spaces, of which 4 are handicapped. 

 

As part of this Petition, the Petitioner is requesting a setbacks variance along the south and east property line.  The setback along the south property line will be reduced from 8' to 4.35', being a 3.65' variance and the setback along the east property line will be reduced from 15' to 0', being a 15' variance.

 

Access to the site will be from Beverly Drive via the private roadways which have already been constructed. A five-foot wide concrete sidewalk will be constructed along Beverly Drive abutting this property. Stormwater management has already been provided for the Subject Property.  Landscaping is being implemented throughout the site. 

 

DISCUSSION:

Staff has reviewed the Final Plan petition, submitted by the petitioner and have sent comments back to them on those submittals. The petitioner has made the requested revisions to these documents and they now meet the applicable codes and ordinances, with the exception of the items mentioned in the Staff Recommendation listed below.

The setback variances along the south side of the property that is being requested abuts detention facilities, therefore, will not have a negative impact on the surrounding properties.

 

Public Input: Due public notice was given for the public hearing on this matter.  As of the date of this memo, staff has not received public inquiries regarding this petition. 

 

POLICIES AND GUIDELINES:

11.1 (3) To encourage new development contiguous to existing development.

 

11.1 (5) To guide and promote development to areas where public utilities, public roads and municipal services are either available or planned.  

 

RECOMMENDATIONS:

The Planning Commission recommends CONDITIONAL APPROVAL of the Resolution Approving a Final Plan on Condo Lot 4 of Lot 5 of Aurora Corporate Center Subdivision and Granting a Setback Variance for property located along the east side of Beverly Drive, south of Ginger Woods Parkway, Aurora, Illinois  60502, with the following conditions:

 

1.  That the percentage and number of each canopy tree equivalent be corrected in the Landscape Material Data Table.

 

2. That the four trees along the south property line that are not within the Subject Property be relocated along the west property line on the berm.

 

3. That the Honeylocust street trees be replaced with an acceptable tree species listed in the City's Approved Street Tree Species List.

 

4. No Genus shall account for more than 33% of any Planting Material Type and no more than three of the same species shall be clustered together.

WHEREAS, the City of Aurora has a population of more than 25,000 persons and is, therefore, a home rule unit under subsection (a) of Section 6 of Article VII of the Illinois Constitution of 1970; and

 

WHEREAS, subject to said Section, a home rule unit may exercise any power and perform any function pertaining to its government and affairs for the protection of the public health, safety, morals, and welfare; and

 

WHEREAS, by petition dated May 5, 2015, Aurora Corporate Center Development Company filed with the City of Aurora a petition requesting approval of a Final Plan with a setback variance on Condo Lot 4 of Lot 5 in the Aurora Corporate Center. and related required documents as attached hereto as Exhibits "A-1" through Exhibit “A-5”; and

 

WHEREAS, after referral of said petition from the Aurora City Council, and after due notice and publication of said notice, the Aurora Planning Commission conducted a public hearing for the setback variance on June 17, 2015, reviewed the petition and recommended CONDITIONAL APPROVAL of said petition; and

 

WHEREAS, on June 25, 2015, the Planning and Development Committee of the Aurora City Council reviewed said Final Plan with a setback variance and the before mentioned recommendations and recommended CONDITIONAL APPROVAL of said petition; and  

 

NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Aurora, Illinois, as follows:

 

Section On: That the City Council of the City of Aurora finds as facts all of the preamble recitals of this Resolution and hereby grants CONDITIONAL APPROVAL of said Final Plan with the setback variance with the following conditions:

 

1.  That the percentage and number of each canopy tree equivalent be corrected in the Landscape Material Data Table.

 

2. That the four trees along the south property line that are not within the Subject Property be relocated along the west property line on the berm.

 

3. That the Honeylocust street trees be replaced with an acceptable tree species listed in the City's Approved Street Tree Species List.

 

4. No Genus shall account for more than 33% of any Planting Material Type and no more than three of the same species shall be clustered together.

 

Section Two: That the following variations are hereby granted from the standards of Ordinance No. 3100, being the Aurora Zoning Ordinance:

 

1. Reduction of the setback requirement from 8' to 4.35', being a 3.65' variance.

 

2.  Reduction of the setback requirement from 15' to 0', being a 15' variance.

 

BE IT FURTHER RESOLVED that the City Council of the City of Aurora hereby adopts the Final Plan and related required documents as attached hereto as Exhibit "A-1" Final Plan, Exhibit “A-2” Landscaping Plan, Exhibit “A-3” Building and Signage Elevations, Exhibit “A-4" Fire Access Plan along with any dedications deemed necessary by the Aurora City Engineer.
