SUBJECT:

Resolution Increasing purchase order number 279074 with Rochelle Waste Disposal from $25,000.00 to $40,000.00. 

 

PURPOSE:

The purpose for this resolution is to increase Purchase Order 279074 with Rochelle Waste and Disposal from $25,000.00 to $40,000.00. The Water and Sewer Division utilizes Rochelle Waste and Disposal to dump excavated soil that does not meet the state of Illinois requirements for Clean Construction Demolition Debris. The excavated soil is generated while repairing existing underground improvements such as water and sewer lines

 

BACKGROUND:

35 Ill. Adm. Code 1100 require soils excavated from sites with a history of activity that may have resulted in soil contamination, be tested prior to disposal. The soils that do not meet the requirements for disposal at a Clean Construction Demolition Debris (CCDD) landfill, must be disposed of at a site permitted to accept such contaminated material. On September 19, 2014 the Director of Purchasing entered into an agreement with Rochelle Waste Disposal that established per ton prices for the disposal of non-hazardous contaminated soils that cannot be disposed of at a CCDD facility. The agreement is valid through September 2nd 2016.

 

At the time of entering into the aforementioned agreement with Rochelle Waste and Disposal, the above testing and disposal requirements were relatively new to the City's Water and Sewer Operations. Due to the lack of historic data on quantities of non-CCDD conforming soils, the Water and Sewer Maintenance Division could not estimate the quantity of contaminated soils that might be encountered on an annual basis. Consequently, a purchase order in the amount not to exceed $25,000.00 was established to pay dump fees for contaminated soils. Between January 1st, 2015 and October 9th, 2015 the Water and Sewer Maintenance Division disposed of 1,649.68 tons of contaminated soil at the Rochelle Waste Disposal facility for a total expense of $26,134.80.

 

The Water and Sewer Maintenance Division is currently storing contaminated soil at its facility until authorization is received to exceed the current $25,000.00 spending threshold.

 

DISCUSSION:

The 2015 budget provides funding for this service in Account 510-4063-511-36-13, Water and Sewer Fund.

 

IMPACT STATEMENT:

This resolution must be adopted in order to ensure that the City of Aurora has the ability to dispose of contaminated soils generated while maintaining its water and sewer infrastructure.

WHEREAS, the City of Aurora has a population of more than 25,000 persons and is, therefore, a home rule unit under subsection (a) of Section 6 of Article VII of the Illinois Constitution of 1970; and

 

WHEREAS, subject to said Section, a home rule unit may exercise any power and perform any function pertaining to its government and affairs for the protection of the public health, safety, morals, and welfare; and

 

WHEREAS, 35 Ill. Adm. Code 1100 requires that excavated spoils that do not meet the Clean Construction Demolition Debris standards be disposed of at a landfill permitted to accept such waste; and

 

WHEREAS, purchase order number 279074 was established to pay for dump fees for contaminated soils generated while maintaining the City of Aurora's water and sewer infrastructure, and

 

WHEREAS, expenditures through purchase order number 279074 have reached the threshold that requires City Council Approval: and

 

WHEREAS, the 2015 budget provides funding for this service in account number 510-4063-511-36-13, Water and Sewer Fund; and

 

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Aurora, Illinois, as follows: The Director of Purchasing is hereby authorized to increase purchase order number 279074 with Rochelle Waste Disposal from $25,000.00 to $40,000.00 to dispose of contaminated soils encountered by the City of Aurora's Water and Sewer Maintenance Division during repairs to the City's water and sewer infrastructure.
