Resolution Authorizing the Acquisition of Property from Francis J. & Elisabeth S. Henry for Right of Way Road Purposes For the Lake Street and River Street Two Way Conversion Project Partial Acquisition PIN: 15-21-476-016), 258 South Lake Street
PURPOSE:
Acquisition of property for right of way roadway purposes at 258 South Lake Street, Aurora, Illinois from Francis J. & Elisabeth S. Henry for the Lake Street and River Street Two Way Conversion project.
BACKGROUND:
The City Council approved a Resolution approving the Professional Engineering Services Agreement with HR Green Inc. for the Lake Street and River Street Two Way Conversion Project on October 28, 2014 Resolution No. R14-268.
The City Council also approved a Resolution Awarding the Lake Street and River Street Two Way Conversion Project to the low bidder in the amount of $2,195,147.40 to General Construction Company on May 26, 2015 Resolution No. R15-0137.
DISCUSSION:
It is necessary for the City to acquire .007 acres of land (311 square feet) more or less of the parcel located at 258 South Lake Street for road purposes. The Engineering Department has negotiated an agreed upon amount with the property owners for said acquisition based on the valuation analysis attached hereto.
The Law Department has reviewed the attached documents conveying the partial acquisition of parcel 15-21-476-016 for right-of-way construction purposes from Francis J. & Elisabeth S. Henry which is necessary for the Lake Street and River Street Two Way Conversion Project to be completed. This is the only acquisition of land that is necessary in order for this Project to proceed.
Said funds are to be paid from the account numbers listed below:

IMPACT STATEMENT:
Unable to proceed to complete the project as previously approved by the City Council.

WHEREAS, the City of Aurora has a population of more than 25,000 persons and is, therefore, a home rule unit under subsection (a) of Section 6 of Article VII of the Illinois Constitution of 1970; and
WHEREAS, subject to said Section, a home rule unit may exercise any power and perform any function pertaining to its government and affairs for the protection of the public health, safety, morals, and welfare; and
WHEREAS, the City of Aurora has determined it is in the best interests of its citizens that certain real estate be acquired for right of way road purposes for the Lake Street and River Street Two Way Conversion (partial acquisition PIN: 15-21-476-016, 258 South Lake Street, Aurora, Illinois .007 acres of land 311 square feet more or less), from property owned by Francis J. & Elizabeth S. Henry; and
WHEREAS, Francis J. & Elisabeth S. Henry have agreed to sell and the City has agreed to purchase land in the proposed right of way for the sum of Five Thousand and 00/100 Dollars ($5,000.00). Copies of the executed conveyance documents along with the legal description of the land to be acquired are attached hereto as Exhibit “A”.)
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Aurora, Illinois, as follows:
That the purchase of the herein described land for the proposed right of way for the Lake Street and River Street Two Way Conversion Project from Francis J. & Elisabeth S. Henry, for the sum of Five Thousand and 00/100 Dollars ($5,000.00) is hereby authorized, and further, the issuance of a draft payable to Francis J. & Elisabeth S. Henry in the amount of Five Thousand and 00/100 Dollars ($5,000.00) is authorized. Attorney Blanca R. Dominguez is hereby authorized to act on the City’s behalf to complete the purchase of this property.
