PURPOSE:
The petitioner, Joe Van Tellingen, is proposing a Variance Petition on 0.24 acres to allow a double axle recreational trailer on a residential lot located at 1317 Plain Avenue. The proposal consists of varying Section 5.13-3.8.1.C.iv. Size of trailer of the Aurora Zoning Ordinance to allow a double axle trailer unenclosed on the subject property, east of the detached garage. The trailer is used for the petitioner's recreational equipment.
BACKGROUND:
This Variance petition referred by the City Council to the Planning and Zoning Division on July 2, 2013. The Committee of the Whole returned this Variance petition back to Zoning Board of Appeals, since the petitioner executed the public notice incorrectly. Due public notice was given and a new public hearing was held on September 4, 2013 by the Zoning Board of Appeals.

DISCUSSION:
Evaluation: Staff reviewed the Variance petition, submitted by the petitioner. The Aurora Zoning Ordinance does not permit double axle trailers unenclosed on residential properties, per Section 5.13-3.8.1.C.iv. Size of trailer of the Aurora Zoning Ordinance. Currently a one axle trailer is allowed on a residential driveway if it is appropriately located and screened.
The Zoning Board of Appeals recommended Conditional Approval of the Variance petition with a condition that the variance is only for the existing double axle trailer. It was discussed that due to the uniqueness of the Subject Property, that granting the variance should not set a precedent for double axle trailers on other properties. Variance hardship was also discussed by the ZBA, mentioning the hardship of not being able to fit the trailer inside the garage.
Public Hearing: Due public notice was given for the public hearing on this matter. No witnesses came forward at the hearing. As of the date of this memo, staff has not received any public inquiries regarding this petition.
IMPACT STATEMENT:
The Planning and Zoning Division does not anticipate any impact to other City Department with the approval of this Petition.
RECOMMENDATIONS:
The Zoning Board of Appeals recommended CONDITIONAL APPROVAL to allow a double axle recreational trailer on a residential lot at1317 Plain Avenue, Aurora, Illinois with the following condition:
1. That this variance is only for the existing double axle trailer and any future double axle trailers will need specific approval.
