Resolution Authorizing the Mayor and City Clerk to Approve the Local Agency Agreement for Federal Participation with the State of Illinois, to Execute the Construction Engineering Agreement with TranSystems and to Appropriate Motor Fuel Tax Funds for the Acquisitions, Construction and Engineering Services related to the Ohio Street Bridge Replacement Project
PURPOSE:
This Resolution will authorize the Agreement to Utilize Federal Funds, Approve the Engineering Services Agreement and Appropriate Motor Fuel Tax (MFT) funds for the Ohio Street Bridge Project.
BACKGROUND:
Since 2009, the City of Aurora and TranSystems have been completing the required studies, permitting, engineering, acquisitions and preparation of plans and specifications for the replacement of the Ohio Street Bridge over the BNSF Railway. This project will be scheduled for an Illinois Department of Transportation (IDOT) bid letting later this year. The City has secured Federal Bridge Funds to pay 80% of the construction and engineering costs. Funding is authorized through the Local Agency Agreement for Federal Participation, noted as Exhibit 'A'. Full time on-site Construction Engineering will be completed by TranSystems as outlined in the Construction Engineering Services Agreement in an amount not to exceed $950,533.57, noted as Exhibit 'B'.
DISCUSSION:
Ohio Street bridge, built in 1924, spans the BNSF Railway & Indian Creek. The structure at 90 years old is the oldest bridge in Aurora and has reached the end of its useful life. This project will completely remove the existing 4 pier, 5 span Thru-Girder structure and construct a new 2 pier, 3 span Steel I-Beam bridge with 2 - 14' lanes, a 12' wide protected path on the west side and 6' sidewalk on the east side. The new bridge will be approximately 12 feet wider and provide 2 feet of additional clearance to the tracks below. The improvements will also include roadway reconstruction between Indian Avenue and Rural Street. The estimated $8,170,000 project is scheduled to begin in 2015 and be completed by November, 2016. The bridge will be closed during construction.
The 2014 City Budget provides $100,000 for this item in account no. 203-4460-431.76-49 (MFT) and balance in the 2015 and 2016 CIP. Attached is the Resolution appropriating $2,700,000 of MFT funds for this project, noted as Exhibit 'C'. This appropriation is for the full amount of Construction Engineering costs of $951,000, the city's share of construction cost anticipated to be $1,634,000, Phase 2 Engineering costs of $60,000 and Acquisition Costs of $55,000. The city will be reimbursed 80% of the Engineering Costs for this project.
IMPACT STATEMENT:
Local traffic will be detoured utilizing the Wood Street bridge.
RECOMMENDATIONS:

WHEREAS, the City of Aurora has a population of more than 25,000 persons and is, therefore, a home rule unit under subsection (a) of Section 6 of Article VII of the Illinois Constitution of 1970; and
WHEREAS, subject to said Section, a home rule unit may exercise any power and perform any function pertaining to its government and affairs for the protection of the public health, safety, morals, and welfare; and
WHEREAS, it is necessary and desirable to replace the existing Ohio Street Bridge built in 1924 with a taller, wider and modern bridge, and
WHEREAS, there is a need for a Local Agency Agreement for Federal Participation to fund 80% of the Ohio Street Bridge Construction and Construction Engineering Services with FHWA funds, a copy of which agreement is attached hereto and incorporated herein as Exhibit 'A'; and
WHEREAS, there is a need for a Construction Engineering Agreement with TranSystems, Inc., 1475 East Woodfield Rd., Suite 600, Schaumburg, IL in an amount not to exceed $950,533.57, a copy of which agreement is attached hereto and incorporated herein as Exhibit 'B'; and
WHEREAS, there is a need to appropriate Motor Fuel Tax funds for this project in the amount of $2,700,000, a copy of which resolution is attached hereto and incorporated herein as Exhibit 'C'; and
WHEREAS, the 2014 City Budget provides $100,000 for this item in account no. 203-4460-431.76-49 (MFT) and balance in the 2015 and 2016 CIP.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Aurora, Illinois, as follows: that the Mayor and City Clerk are hereby authorized to execute the Local Agency Agreement as set forth in Exhibit 'A', the Construction Engineering Services Agreement with TranSystems, Inc. as set forth in Exhibit 'B' and the Resolution for Improvement by Municipality Under the Illinois Highway Code as set forth in Exhibit 'C'.
