SUBJECT:
Resolution Authorizing the Mayor to sign the Local Agency Agreement for Federal Participation with the State of Illinois, the Director of Purchasing to sign the Construction Engineering Agreement with V3 Companies and to Appropriate Motor Fuel Tax Funds for the Acquisitions, Construction and Engineering Services related to the Sheffer Road Bridge Replacement Project  
 
PURPOSE:
This Resolution will authorize the Agreement to Utilize Federal Funds, Approve the Engineering Services Agreement and Appropriate Motor Fuel Tax (MFT) funds for the Sheffer Road Bridge Project
 
BACKGROUND:
Sheffer Road Bridge is located just east of Farnsworth Avenue over Indian Creek.  The existing bridge constructed in 1933 is a narrow concrete slab with severe concrete deterioration. This project will remove the existing bridge, relocate the existing water main and sewers and construct a wider 2 lane bridge with shoulders, guardrail and improved approach pavement.
 
DISCUSSION:
The City has secured Federal Bridge Funds to cover 80% of the project costs. The Local Agency Agreement with the Illinois Department of Transportation (IDOT) and the Engineering Agreement for Federal Participation are required to be approved by the city council.
The attached Local Agency Agreement for Federal Participation - BLR 05310 (Exhibit 'A') defines the Division of Cost for Construction and Engineering utilizing Federal Funds to cover 80% of the cost with a maximum STP- Br Federal Participation Funds of $1,328,000 and a final City share of $332,000.
 
The attached Engineering Agreement for Federal Participation - BLR 05611 (Exhibit 'B') from V3 Companies in the amount of $156,543.35 will provide Construction Engineering Services required for the project. The City will front fund these engineering costs with Motor Fuel Tax (MFT) funds and will be reimbursed 80% of the costs or approximately $128,000.  
 
IDOT requires a Resolution to Appropriate the MFT funds prior to their expenditure for approved projects.  The Resolution for Improvement - BLR 09111 (Exhibit 'C') appropriating MFT funds in the amount of $470,000 for this project is also attached.
 
IDOT has requested 5 copies of each agreement with original signatures and 2 copies of the MFT Resolution.  The 2015 Budget provides $470,000 for this item in account no. 203-4460-431.76-50 (Motor Fuel Tax Funds).
 
 
IMPACT STATEMENT:
We anticipate an IDOT April letting and award by June, 2015.  Construction could begin in July or August and completion by December, 2015.  During construction, Sheffer Road east of Farnsworth Avenue will be closed to through traffic.  A detour route will be posted using Indian Trail.
 
RECOMMENDATIONS:

WHEREAS, the City of Aurora has a population of more than 25,000 persons and is, therefore, a home rule unit under subsection (a) of Section 6 of Article VII of the Illinois Constitution of 1970; and
 
WHEREAS, subject to said Section, a home rule unit may exercise any power and perform any function pertaining to its government and affairs for the protection of the public health, safety, morals, and welfare; and
 
WHEREAS, it is necessary and desirable to replace the existing Sheffer Road Bridge, and
 
WHEREAS, there is a need for a Local Agency Agreement for Federal Participation to fund 80% of the project with FHWA funds, a copy of which agreement is attached hereto and incorporated herein as Exhibit 'A'; and
 
WHEREAS, there is a need for a Construction Engineering Agreement with V3 Companies, 7325 Janes Avenue, Woodridge, IL  in an amount not to exceed $156,543.35, a copy of which agreement is attached hereto and incorporated herein as Exhibit 'B'; and
 
WHEREAS, there is a need to appropriate Motor Fuel Tax funds for this project in the amount of $470,000, a copy of which resolution is attached hereto and incorporated herein as Exhibit 'C'; and  
 
WHEREAS, the 2015 City Budget provides $470,000 for this item in account no. 203-4460-431.76-50 (Motor Fuel Tax funds).
 
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Aurora, Illinois, as follows: that the Mayor is hereby authorized to execute the Local Agency Agreement as set forth in Exhibit 'A' or the most current document revised by IDOT; the Director of Purchasing is hereby authorized to sign the Construction Engineering Services Agreement with V3 Companies as set forth in Exhibit 'B' or the most current document revised by IDOT and the appropriation of Motor Fuel Tax funds as stated in the Resolution for Improvement by Municipality Under the Illinois Highway Code as set forth in Exhibit 'C'.
