SUBJECT:

Resolution to approve an amendment to an existing professional services agreement with HR Green, inc. in the amount of $247,259.51. The existing agreement was approved under resolution R21-336 (PO 297197) approved 11/23/2021

 

PURPOSE:

To authorize the amendment in order to authorize the purchase of ROW in order to expedite the Bilter Road Improvements- Premium Outlets to Prairie Path project.

 

BACKGROUND:

With the Phase I engineering services advanced far enough to establish a proposed right-of-way (ROW) footprint, Staff have decided to pause the Phase I engineering services and instead focus on acquiring the ROW needed for the future roadway improvements.

 

DISCUSSION:

Exhibit A in the attached professional services agreement elaborates on the scope of the work that will be performed by HR Green and Santacruz Land Acquisitions. This work is planned in the section of Bilter Road that the City has already procured federal funding (Premium Outlets Blvd to the Illinois Prairie Path. This amendment will help the grant be utilized quicker and provide improvements to the City roadway infrastructure in a more timely manner.

 

This is budgeted for under item GB 039 and has $800,000 budgeted for 2025

 

Account(s): 238-4060-431.79-58 ($100,000) and 340-4060-431-79.58 ($147,259.51).

 

IMPACT STATEMENT:

This project amendment  should not have any impact on the general public as the nature of the work is not construction. Removing the property acquisition from the federal process will make the acquisition process happen faster so that the construction can eventually take place sooner.

 

RECOMMENDATIONS:

Staff recommends the proposed resolution be adopted

WHEREAS, the City of Aurora has a population of more than 25,000 persons and is, therefore, a home rule unit under subsection (a) of Section 6 of Article VII of the Illinois Constitution of 1970; and

 

WHEREAS, subject to said Section, a home rule unit may exercise any power and perform any function pertaining to its government and affairs for the protection of the public health, safety, morals, and welfare; and

 

WHEREAS, property acquisition is necessary in order to improve Bilter Road from Premium Outlets Blvd to the Illinois Prairie Path, and

 

WHEREAS, Account(s) 238-4060-431.79-58 ($100,000) and 340-4060-431-79.58 ($147,259.51) GB039 has sufficient funds allocated for this amendment

 

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Aurora, Illinois, as follows: a professional services agreement with HR Green in the amount of $247,259.51 for the Bilter Road Improvements- Premium Outlets to Prairie Path project is hereby approved and the director of purchasing is hereby authorized to enter into such a contract on behalf of the City.
