A Resolution Establishing the Maximum Number of City of Aurora Liquor Licenses by Class.
PURPOSE:
To maintain the number of Class A: Package Sales licenses and to allow the conversion of Prisco's Fine Foods, Inc. d/b/a Prisco's Family Market from a Class G (Package Beer & Wine Only) to a Class A: Package Sales (Full Liquor) license.
BACKGROUND:
This request is asking for a modification of the liquor license classification for Prisco's. Prisco's currently holds a Class G (Package Beer & Wine) license and the license is automatically eligible for conversion to a Class A: Package Sales (Beer & Wine) license. Prisco's requests that their license be converted to a Class A: Package Sales (Full Liquor) license.
DISCUSSION:
Prisco's is an established grocery store in the City of Aurora and has maintained a City of Aurora liquor license since 1993. Grocery stores meeting criteria enumerated in the City Code can be eligible for the Class A - Package Sales (Full Liquor) license. Prisco's meets the criteria for said license.
Attached is the application submitted for your consideration. If approved, this resolution would maintain the number of allowable liquor licenses as indicated in the accompanying Exhibit A but would allow Prisco's the opportunity to sell liquor, in addition to beer and wine, by allowing the conversion of their license to a Class A - Package Sales (Full Liquor) license.
IMPACT STATEMENT:
The proposed resolution will allow Prisco's Fine Foods, Inc. to expand their product offerings to further the City of Aurora's economic development.
RECOMMENDATIONS:
It is recommended that this resolution be referred to the Committee of the Whole for consideration at its November 17, 2020 meeting and then referred to the City Council for consideration at its November 24, 2020 meeting.

WHEREAS, the City of Aurora has a population of more than 25,000 persons and is, therefore, a home rule unit under subsection (a) of Section 6 of Article VII of the Illinois Constitution of 1970; and
WHEREAS, subject to said Section, a home rule unit may exercise any power and perform any function pertaining to its government and affairs for the protection of the public health, safety, morals, and welfare; and
WHEREAS, in accordance with Section 4-1 of the Illinois Liquor Control Act, 235 ILCS 5/4-1, and Section 6-9 of the City of Aurora Liquor Ordinance, the City Council may establish the maximum number of allowed liquor licenses within the City of Aurora; and
WHEREAS, in accordance with Section 6-9, it is the desire of the City Council to increase and decrease the maximum number of allowed liquor licenses within the City of Aurora as reflected in the schedule attached hereto as Exhibit A.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Aurora, Illinois, as follows: that the allowable liquor licenses are established as set forth in Exhibit A, herein.
