A Resolution Approving a Final Plan on Lot 1 for World Class Wireless Subdivision, Located at 2800 Diehl Road, for a Business and Professional, Office (2400) Use and a Warehouse, Distribution and Storage Services (3300) Use (Logistics Property Company, LLC - 21-0947 - NA05/3-21.334-Fpn - SB - WARD 10)
PURPOSE:
The Petitioner, Logistics Property Company, LLC, is requesting approval of a Final Plan for the property located at 2800 Diehl Road for a Business and Professional, Office (2400) use and a Warehouse, Distribution and Storage Services (3300) use.
BACKGROUND:
The Subject Property is zoned ORI, Office, Research, and Light Industrial. The Subject Property is approximately twenty-two (22) acres and is presently vacant, with the exception of an access point from Diehl Road for a driveway to the Utility Building on Lot 2 of the World Class Wireless subdivision. The Subject Property fronts on Diehl Rd. and N. Eola Rd. The State of Illinois owns the parcel of land that is located between the Subject Property’s north side and the Toll Road. Additional information on the legislative history of the property can be found in the attached Property Research Sheet.
The Petitioner is requesting approval of a Final Plan for a Business and Professional, Office (2400) and Warehouse, Distribution and Storage Services (3300) use. The details of the request include construction of an approximately three hundred thousand, ninety-three thousand (393,000) square foot building for office and warehouse use. There will be approximately four hundred (400) passenger vehicle parking spaces and twenty-six (26) truck trailer parking spaces on the building’s east side. The Subject Property will include an expanded, full access point onto Diehl Rd, which will be located in the same general location as the currently existing access point. The Subject Property will also include a new Fire Lane from North Eola Rd. The building itself will be forty (40) feet tall and will have exterior materials that consist of precast concrete wall panels.
DISCUSSION:
Staff has reviewed the Final Plan petition and have sent comments back to the Petitioner based on those submittals. The Petitioner has made the requested revisions to these documents and they now meet the applicable codes and ordinances.
Staff feels, however, that the building’s exterior design, especially along the Tollway at the northeast and northwest corners, could be revised to more fully reflect a faux office look, by including a more appealing design, which includes more windows then currently shown.
POLICIES AND GUIDELINES:
The Staff’s Evaluation and Recommendation are based on the following Physical Development Policies:
13.1 (5): To develop major retail, office, and industrial uses that rely on efficient
access to expressways in the vicinity of expressway interchanges.
41.1 (2): To promote a balance of industries within the City.
41.1 (3): To encourage the location of industrial, office, and office-research
development near transportation facilities designed to provide adequate
and efficient linkages to sources of labor, production materials, and
markets.
RECOMMENDATIONS:
Staff would recommend APPROVAL of the resolution approving a Final Plan on Lot 1 for World Class Wireless Subdivision, located at 2800 Diehl Road, for a Business and Professional, Office (2400) use and a Warehouse, Distribution and Storage Services (3300) use, with the following conditions:
1) Submit plans and supporting documents to the Engineering Division, along with any fees and security required, to obtain Final Engineering Approval from the Engineering Division.
2) Obtain approval from the DuPage County Division of Transportation for all work proposed in the Eola Road right-of-way.
3) Obtain approval from the Illinois State Toll Highway Authority (ISTHA) for all work proposed on ISTHA property and any stormwater discharge to ISTHA property.
4) Grant all easements required by the Engineering Division for various utilities and stormwater management.

WHEREAS, the City of Aurora has a population of more than 25,000 persons and is, therefore, a home rule unit under subsection (a) of Section 6 of Article VII of the Illinois Constitution of 1970; and
WHEREAS, subject to said Section, a home rule unit may exercise any power and perform any function pertaining to its government and affairs for the protection of the public health, safety, morals, and welfare; and
WHEREAS, by petition dated November 12, 2021, Logistics Property Company, LLC, filed with the City of Aurora a petition, Requesting approval of a Final Plan for Lot 1 of World Class Wireless, Unit 1, located west of North Eola Road and North of Diehl Road, for a Business and Professional, Office (2400) use and a Warehouse, Distribution and Storage Services (3300) use, and related required documents as attached hereto as Exhibits “A-1” through Exhibit “A-3”; and
WHEREAS, on December 15, 2021, the Building, Zoning and Economic Development Committee of the Aurora City Council reviewed said Final Plan and the before mentioned recommendations and recommended APPROVAL of said petition; and
WHEREAS, the decision of the Building, Zoning and Economic Development Committee with respect to a final plan is subject to appeal to the City Council in the manner set forth in Chapter 34 of the Code of Ordinances, City of Aurora; and
WHEREAS, no person authorized under Chapter 34 of the Code of Ordinances, City of Aurora to appeal such decision having done so in the manner set forth in Chapter 34, the Decision of the Building, Zoning and Economic Development Committee constitutes final action on the proposed final plan; and
NOW, THEREFORE, BE IT RESOLVED that the Building, Zoning and Economic Development Committee of the City of Aurora, Illinois, finds as facts all of the preamble recitals of this Resolution and hereby grants APPROVAL of said Final Plan with the following conditions:
1) Submit plans and supporting documents to the Engineering Division, along with any fees and security required, to obtain Final Engineering Approval from the Engineering Division.
2) Obtain approval from the DuPage County Division of Transportation for all work proposed in the Eola Road right-of-way.
3) Obtain approval from the Illinois State Toll Highway Authority (ISTHA) for all work proposed on ISTHA property and any stormwater discharge to ISTHA property.
4) Grant all easements required by the Engineering Division for various utilities and stormwater management.
BE IT FURTHER RESOLVED that the Building, Zoning and Economic Development Committee of the City of Aurora hereby adopts the Final Plan and related required documents, as attached hereto as Exhibit "A-1" Final Plan, Exhibit “A-2” Landscape Plan, and Exhibit “A-3” Building and Signage Elevations, along with any easement dedications deemed necessary by the Aurora City Engineer.
