SUBJECT:
A Resolution for Acceptance of Improvements and Waiving the Maintenance Period for Bell-Gale Industrial Condominium Park.
 
PURPOSE:
To accept the Public Improvements and waive the required maintenance period for Bell-Gale Industrial Condominium Park.
 
BACKGROUND:
This development has completed all installations, inspections and submissions of the public improvements that make it eligible to be recommended for final acceptance of those improvements.
 
DISCUSSION:
The Subdivision Control Ordinance, upon the acceptance of the improvements by City Council, requires the posting of a security for a one year maintenance period. Due to project specific circumstances we recommend waiving the required maintenance security.
 
IMPACT STATEMENT:
This action may add new public infrastructure /utilities to various divisions for maintenance, including streets, water, storm, sanitary, electrical, storm water management, fiber optic.
 
RECOMMENDATIONS:
Due to project specific circumstances, the City Engineer recommends the acceptance of the public improvements and waiving of the maintenance period.

WHEREAS, the City of Aurora has a population of more than 25,000 persons and is, therefore, a home rule unit under subsection (a) of Section 6 of Article VII of the Illinois Constitution of 1970; and
 
WHEREAS, subject to said Section, a home rule unit may exercise any power and perform any function pertaining to its government and affairs for the protection of the public health, safety, morals, and welfare; and
 
WHEREAS, Centrue Bank the developer of Bell-Gale Industrial Condominium Park, has completed the public improvements for said project under a re-development agreement with the City; and
 
WHEREAS, these said improvements have been inspected during construction by the Engineering Division, or their authorized representative, and were found to be in substantial conformance with the approved plans and the aforementioned re-development agreement; and
 
WHEREAS, the City Engineer has recommended acceptance of the improvements and waiving of the maintenance period)
 
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Aurora, Illinois, as follows: that the Bell-Gale Industrial Condominium Park improvements be accepted and the maintenance period be waived.
