SUBJECT:

An Ordinance Changing the Name of Indian Trail, Indian Trail Road, New Indian Trail Road, West Indian Trail Road, East Indian Trail Road, and Indian Trail Drive to W. Indian Trail and E. Indian Trail in Kane and DuPage County, Aurora, Illinois (The City of Aurora - 18-0103 / KDWK-18.030-M - TV - Ward 1, 5, 6, 10)  

 

PURPOSE:

The City of Aurora is requesting a street name change from Indian Trail, Indian Trail Road, New Indian Trail Road, West Indian Trail Road, East Indian Trail Road, and Indian Trail Drive to W. Indian Trail and E. Indian Trail.  

 

BACKGROUND:

The Kane County GIS office has contacted the City, on behalf of KaneComm 911 who dispatches for the Kane County Sheriff's office as well as other emergency services within the region, regarding the "Indian Trail Road" street name within the City of Aurora.  Based on recorded subdivision plats, there are several different forms of the road names for essentially the same street within the City of Aurora, causing a public safety issue for the emergency responders. 

 

DISCUSSION:

The Street Name Committee, made up of Engineering Department, Planning and Zoning Division, Fire Prevention, Aurora Police Department, and Information Technology Division, has reviewed the Street Name Change petition and have determined that it meets the applicable codes and ordinances. 

 

IMPACT STATEMENT:

The properties along this street are currently addressed off W. Indian Trail and E. Indian Trail, therefore, this street name change will not have any impact addressing. However, there are a number of street signs that will need to be updated to reflect the correct street name.

 

This will also fix the County's records so that they can provide KaneComm 911 with the updated and accurate information.  

 

RECOMMENDATIONS:

Staff would recommend APPROVAL of the Ordinance Changing the Name of Indian Trail, Indian Trail Road, New Indian Trail Road, West Indian Trail Road, East Indian Trail Road, and Indian Trail Drive to W. Indian Trail and E. Indian Trail in Kane and DuPage County, Aurora, Illinois

WHEREAS, the City of Aurora has a population of more than 25,000 persons and is, therefore, a home rule unit under subsection (a) of Section 6 of Article VII of the Illinois Constitution of 1970; and

 

WHEREAS, subject to said Section, a home rule unit may exercise any power and perform any function pertaining to its government and affairs for the protection of the public health, safety, morals, and welfare; and

 

WHEREAS, The City of Aurora  desires, pursuant to Section 42-3 and 42-20 of Article I of Chapter 42 of the Aurora Code of Ordinance to change the name of a former portion of Indian Trail, Indian Trail Road, New Indian Trail Road, West Indian Trail Road, East Indian Trail Road, and Indian Trail Drive to W. Indian Trail and E. Indian Trail as hereinafter set forth; and 

 

NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Aurora, Illinois, as follows:

 

Section One: That the City Council of the City of Aurora, Illinois finds as fact all of the preamble recitals of this Ordinance.

 

Section Two: That this Ordinance shall be in full force and effect, and shall be controlling, upon its passage and approval.

 

Section Three: That all Ordinances or part of Ordinances in conflict herewith are hereby repealed insofar as any conflict exists. 

 

Section Four: That any section, phrase or paragraph of this Ordinance that is construed to be invalid, void or unconstitutional shall not affect the remaining sections, phrases or paragraphs of this Ordinance which shall remain in full force and effect.

 

Section Five: That the name of former Indian Trail, Indian Trail Road, New Indian Trail Road, West Indian Trail Road, East Indian Trail Road, and Indian Trail Drive to W. Indian Trail be and is hereby changed to W. Indian Trail, located within Sections 12 and 13 of Sugar Grove Township, Sections 7, 8, 9, 10, 15, 16, 17, and 18 of Aurora Township, Kane County, Illinois, all as shown on the plat attached hereto as Exhibit “A-1”, and made a part hereof.

 

Section Six: That the name of former Indian Trail, Indian Trail Road, New Indian Trail Road, West Indian Trail Road, East Indian Trail Road, and Indian Trail Drive to E. Indian Trail be and is hereby changed to E. Indian Trail, located within Sections 10, 11, 12, 13, 14, and 15 of  Aurora Township and Sections 7, 17, and 18 of  Naperville Township, Kane and DuPage County, Illinois, all as shown on the plat attached hereto as Exhibit "A-2", and made a part hereof.

 

Section Seven: That the City Clerk of the City of Aurora, Illinois, is hereby directed to forward a copy of this Ordinance after its passage and signing to the Director of Public Works so that the street sign may be changed, the Aurora Police Department / Communication - 911, and the Fire Marshall so that the name change may be noted on the “emergency response maps” and to the Zoning Administrator and the Planning Director so that the name change may be noted on the Official Zoning Maps of the City of Aurora, and record this Ordinance at the Kane and DuPage County Recorder’s office.
