A Resolution amending an Intergovernmental Agreement with the State of Illinois for Traffic Signal Maintenance and Electrical Energy responsibilities dated July 1, 2011.  
 
PURPOSE:
To obtain approval for an Amendment to Intergovernmental Agreement with the State for Traffic Signal Maintenance and Electrical Energy responsibilities.
 
BACKGROUND:
The City of Aurora entered into an Intergovernmental Agreement with the State for traffic signal maintenance and electrical energy responsibilities dated July 1, 2011 that included signalized intersections (As indicated in Attachment A). The cost share in the existing Exhibit A of the Master Agreement was incorrectly identified by the State as 66 2/3%-State, 33 1/3%-City for both maintenance and energy at mentioned US 34 intersections, and 50%-State -25% City on energy at IL59 that requires revisions to reflect with current condition.
 
DISCUSSION:
To correct the occurred inaccuracy, an Amendment to the City's Master Agreement- Exhibit A is in order to reflect and comply with the current condition and Jurisdictions. State needs 3 copies of the Amendment executed by the City and returned to IDOT for final processing and execution so a completed Amendment could be sent back to the City upon its execution. A provision for the City's Jurisdictions at the intersections (Attachment A) share of cost responsibility is indicated in Attachment B.
 
 
IMPACT STATEMENT:
Maintenance cost as indicated will be applicable from the City's part.
 
RECOMMENDATIONS:
Staff recommends approval of the Amended Intergovernmental Agreement.

WHEREAS, the City of Aurora has a population of more than 25,000 persons and is, therefore, a home rule unit under subsection (a) of Section 6 of Article VII of the Illinois Constitution of 1970; and
 
WHEREAS, subject to said Section, a home rule unit may exercise any power and perform any function pertaining to its government and affairs for the protection of the public health, safety, morals, and welfare; and
 
WHEREAS, the City entered into an Intergovernmental Agreement with the State of Illinois on July 1, 2011 to provide for traffic signal maintenance and electrical energy responsibilities and related cost sharing for those certain identified signaled intersections; and
 
WHEREAS, the proposed amendment to this Intergovernmental Agreement is required by the State to correct the cost sharing provisions for continual support and maintenance of the identified traffic signals, all as set forth in the attached Exhibit "A";
 
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Aurora, Illinois, as follows: that the proposed Amendment to the Intergovernmental Agreement with the State of Illinois for traffic signal maintenance and electrical energy responsibilities and cost sharing, as set forth in the attached and incorporated Exhibit "A", is hereby approved.
