SUBJECT:
A resolution establishing the maximum number of licenses in the City of Aurora in accordance with Chapter 25, Article XI "Tattoo and Body Art Establishments".
PURPOSE:
To update the number of available licenses for tattoo and body art establishments.
BACKGROUND:
In conjunction with the changes recently approved by the City Council to Chapter 25, Article XI "Tattoo and Body Art Establishments", this resolution seeks to increase the number of available licenses from two (2) to four (4).
DISCUSSION:
This change will allow each of the existing tattoo and body art establishments currently operating in the City of Aurora to have a valid license.
IMPACT STATEMENT:
Approval of this resolution will have a positive impact on the four (4) existing tattoo and body art establishments.
RECOMMENDATIONS:
Staff respectfully requests approval of this resolution.

WHEREAS, the City of Aurora has a population of more than 25,000 persons and is, therefore, a home rule unit under subsection (a) of Section 6 of Article VII of the Illinois Constitution of 1970; and
WHEREAS, subject to said Section, a home rule unit may exercise any power and perform any function pertaining to its government and affairs for the protection of the public health, safety, morals, and welfare; and
WHEREAS, in accordance with Chapter 25, Article XI entitled, Tattoo and Body Art Establishments" of the City of Aurora Code of Ordinances, the City Council may establish, from time to time, the maximum number of allowed tattoo establishments within the City of Aurora; and
WHEREAS, currently there are four (4) tattoo and body art establishments located and doing business in the City of Aurora; and
WHEREAS, in 2012, R12-163 created two (2) licenses for tattoo and body art establishments;
WHEREAS, after review and consideration the City now seeks to increase the number of licenses for tattoo and body art from two (2) to four (4) to cover the four current tattoo and body art establishments lawfully operating within the City.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Aurora, Illinois, as follows: in accordance with Sec. 25-266(d) “License Required; Limit on Number Issued” of Chapter 25, Article XI (Tattoo and Body Art Establishments), the number of licenses available in the City of Aurora is hereby set at four (4).
AND BE IT FURTHER ORDAINED, that any prior resolutions that are inconsistent or conflict with this resolution shall be and are hereby repealed.
