Resolution approving the issuance of a Carnival License to Variety Children's Charity / Fantasy Amusement Company for a carnival to be held at Westfield Fox Valley Mall on May 1-4 and May 8-11, 2014.
PURPOSE:
Variety Children's Charity and Fantasy Amusement Company have applied for a Carnival License for a carnival to be held at the Westfield Fox Valley mall on May 1st through May 4th, and May 8th through May 11th, 2014.
BACKGROUND:
Fantasy Amusement Co., sponsored by Variety Children's Charity, held carnivals at this location and same time of year in 2012 and 2013.
DISCUSSION:
If approved, this would be the third consecutive year Fantasy Amusement Company holds a carnival at the same location. The applicant has provided the required insurance and bond documentation, a copy of the event layout, an application for an Operational Permit from the Fire Prevention Bureau, and a consent letter from Westfield Fox Valley Mall confirming their approval to occupy Lot C from April 28th through May 12th, 2014.
City Staff (Fire Prevention, Police Department, Law Department and the City Clerk's office) will work closely with them to ensure additional requirements (IL Dept. of Labor ride operation permits, DuPage County Health Department certificate, Fire Prevention operational permit) are met prior to the issuance of a license. Additionally, as required by the State of Illinois, all operators, attendants and assistants will be appropriately screened, and a list of these employees will be provided to the office of the City Clerk prior to the event.
The City of Aurora Municipal Code provides that no carnival may operate in one location for more than five (5) days, and that there shall be no more than two (2) carnivals on any one particular site during any calendar year. Westfield's general manager is aware that this carnival, if approved, will count as two (2) separate events at the Fox Valley Mall - the maximum number allowed for one location.
RECOMMENDATIONS:
I request that this item be referred to the Government Operations Committee for a recommendation to approve a Resolution to issue a Carnival License for a carnival to be held at the Westfield Fox Valley Mall on the above mentioned dates.

WHEREAS, the City of Aurora has a population of more than 25,000 persons and is, therefore, a home rule unit under subsection (a) of Section 6 of Article VII of the Illinois Constitution of 1970; and
WHEREAS, subject to said Section, a home rule unit may exercise any power and perform any function pertaining to its government and affairs for the protection of the public health, safety, morals, and welfare; and
WHEREAS, Variety Children's Charity / Fantasy Amusement Company have submitted an application to hold a carnival at Westfield Fox Valley Mall on May 1-4 and May 8-11, 2014; and
WHEREAS, Fantasy Amusement Company has provided required documentation and paid all applicable fees; and
WHEREAS, Fantasy Amusement Company has agreed to provide final documentation prior to the issuance of the license sought; and
WHEREAS, pursuant to Aurora Code Sections 8-43 and 8-44, the City Council shall, after review of a complete application, have the discretion to grant of deny the issuance of a carnival license,
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Aurora, Illinois, as follows: that a Carnival License be issued to Variety Children's Charity / Fantasy Amusement Company for May 1-4 and May 8-11, 2014 at Westfield Fox Valley Mall.
