PURPOSE:
The petitioner, N. L. and J. S. Titiner, Declaration of Trust, is proposing a Rezoning and Special Use Petition with a Planned Development to rezone property from O Office District and B-2 Business District, General Retial to B-2(S)Buisness District, General Retail with a Special Use Planned Development for a new grocery store located 212 N. Lake Street and 221 Spruce Street.
 
BACKGROUND:
This Rezoning and Special Use petition was referred by the City Council to the Planning and Zoning Division on October 15, 2013.

DISCUSSION:
Development Proposal: The proposal consists of rezoning the property at 221 Spruce Street from O Office District to B-2 Business District.  Additionally, the Petitioner is proposing a Special Use for a Planned Development for the entire property which comprises 212 N. Lake Street and 221 Spruce Street.   To facilitate the redevelopment of this property, the Special Use Planned Development varies certain Bulk Restrictions, including the reduction of the required parking and building setbacks along Lake Street, Spruce Street and Wilder Street, which already exist and the modification to the parking requirement from 1 space per 200 square feet to 1 space per 285 square feet.
 
Evaluation:  Staff has reviewed the Rezoning and Special Use petition, submitted by the petitioner and have sent comments back to them on those submittals.  The petitioner has made all the requested changes to the Plan Description.  This Special Use Planned Development will help facilitate the redevelopment of the Subject Property.  The setback reduction is just establishing the existing conditions of the site.  With the demolish to the Office building at 221 Spruce Street and the expansion of the parking lot,  the property will still not meet the parking requirement, however, there will be more on-site parking provided than ever before.
 
Public Input: Due public notice was given for the public hearing on this matter and as of the date of this staff report the Planning and Zoning Division has not received any inquiries regarding this case. No witnesses came forward at the public hearing.
 
IMPACT STATEMENT:
This item will increase the tax base and overall viability of the City which will offset any incidental Department or staffing impacts.
 
RECOMMENDATIONS:
The Planning Commission recommended APPROVAL of the Rezoning and Special Use Petition to rezone property from O and B-2 to B-2(S) with a Special Use Planned Development for a new grocery store at 212 N. Lake Street and 221 Spruce Street by N. L. and J. S. Titiner, Declaration of Trust.
