SUBJECT:
Resolution to approve estoppel certificates for the solar farm development at the Aurora Airport.
PURPOSE:
Developer (SunCode) needs these estoppel certificates for development financing.
BACKGROUND:
The City previously approved the development agreement and leases for solar faram development at the Airport. To complete the development the developer is requesting the City, as the landlord, execute these certificates to confirm with the developer's lender that the lease terms are accurate.
DISCUSSION:
The execution of these certificates is standard practice in real estate transactions and are intended to confirm that the terms of the lease are accurate.
IMPACT STATEMENT:
Without these certificates it is likely the development will not proceed.
RECOMMENDATIONS:
Staff recommends approval.

WHEREAS, the City of Aurora has a population of more than 25,000 persons and is, therefore, a home rule unit under subsection (a) of Section 6 of Article VII of the Illinois Constitution of 1970; and
WHEREAS, subject to said Section, a home rule unit may exercise any power and perform any function pertaining to its government and affairs for the protection of the public health, safety, morals, and welfare; and
WHEREAS, Legistar files 23-0561, 23-0574, and 23-0575 were resolutions authorizing the execution of an option and land lease of real property located at the Aurora Municipal Airport; and
WHEREAS, to secure adequate financing for the construction of the solar farm, the developer's lender is requiring estoppel certificates; and)
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Aurora, Illinois, as follows: the Mayor is authorized to sign and execute the estoppel certificates for the solar farm development at the airport.
