A Resolution approving a revision to the Preliminary Plat for Butterfield Phase II Unit 4C located south of Ferry Road between Frieder Lane and Meridian Road (Old Dominion Freight Line, Inc. - 15-01144 / NA04/1-15.226-Ppn/Psd/R - AM - Ward 10)
PURPOSE:
The Petitioner, Old Dominion Freight Line, Inc., is requesting approval of a Preliminary Plat Revision for Butterfield Phase II Unit 4 located south of Ferry Road east of Eola Road which includes the expansion of Lot 402 to include an additional 4.96 acres located at the northwest corner of Sunrise Road and Meridian Road.
BACKGROUND:
The Subject Property is located south of Ferry Road between Frieder Lane and Meridian Road. The majority of the property (12.65 acres) was previously annexed and rezoned under the Butterfield Planned Development District, the remaining acres is being proposed to be annexed and rezoned under the same planned development concurrently with this petition. Additional information on the legislative history of the property can be found in the attached Property Information Sheet.
The details of the proposal include the construction of a new 53,200 square foot motor truck terminal, the extension of City water lines, extension of sewer service from the existing Lift Station, roadway improvements for Meridian Road and Sunrise Road and a stormwater detention pond.
Concurrently with this proposal, the Petitioner is proposing a Preliminary Plan for Lot 402 of Butterfield Phase II Unit 4C and an Annexation Agreement and Annexation of 4.96 acres of the Subject Property.
DISCUSSION:
Staff has reviewed the Preliminary Plat petition and have sent comments back to the petitioner on those submittals. The petitioner has made the requested revisions to these documents and they now meet the applicable codes and ordinances.
POLICIES AND GUIDELINES:
The Staff’s Evaluation and Recommendation are based on the following Physical Development Policies:
11.1 (5) To guide and promote development to areas where public utilities, public roads and municipal services are either available or planned.
12.0 To plan and provide for the growth of the city through the integration of land use patterns and functions that promotes complementary interactions between different land use components.
31.1 (3) To promote the development of commercial facilities in existing or planned commercial areas.
RECOMMENDATIONS:
The Planning Commission recommends DENIAL of the resolution approving a revision to the preliminary plat for Butterfield Phase II Unit 4C located south of Ferry Road east of Eola Road.

WHEREAS, the City of Aurora has a population of more than 25,000 persons and is, therefore, a home rule unit under subsection (a) of Section 6 of Article VII of the Illinois Constitution of 1970; and
WHEREAS, subject to said Section, a home rule unit may exercise any power and perform any function pertaining to its government and affairs for the protection of the public health, safety, morals, and welfare; and
WHEREAS, by petition dated December 30, 2015, Old Dominion Freight Line, Inc. filed with the City of Aurora a petition requesting approval of a Preliminary Plat Revision for Butterfield Phase II Unit 4 located south of Ferry Road east of Eola Road and related required documents as attached hereto as Exhibits "A"; and
WHEREAS, after referral of said petition from the Aurora City Council, the Aurora Planning Commission on May 18, 2016, reviewed the petition and recommended DENIAL of said petition; and
WHEREAS, on May 26, 2016, the Planning and Development Committee of the Aurora City Council reviewed said Preliminary Plat Revision and the before mentioned recommendations and recommended ___________ of said petition; and
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Aurora, Illinois, finds as fact all of the preamble recitals of this Resolution and hereby grants ___________ of said Preliminary Plat.
BE IT FURTHER RESOLVED that the City Council of the City of Aurora hereby adopts the Preliminary Plat and related required documents as attached hereto as Exhibit "A" Preliminary Plat.
