SUBJECT:

Resolution authorizing the Director of Purchasing to enter into intergovernmental agreements with various agencies/entities to piggyback onto the City of Aurora Job Order Contracting Services (JOC) program. 

 

PURPOSE:

To obtain approval for the Director of Purchasing to enter into Intergovernmental Agreements that allow agencies/entities to use our Job Order Contracting Services program (Legistar 20-0469)

 

BACKGROUND:

The City is entering into a new form of purchasing for capital projects as detailed in Legistar 20-0469.  This form of purchasing allows an outside third party administrator to select competitive contractor and subcontractor pricing for a variety of projects per City specifications.  Once created, these programs are of great interest to other communities (the City of Aurora used the City of Naperville JOC program for several years), and as such the City can charge an access fee to use the program.  The Intergovernmental Agreement will be required to ensure the City knows who is using the program, and ensuring there are no outstanding issues with the agency/entity prior to use.

 

DISCUSSION:

F.H. Paschen, S.N. Nielsen and Associates, LLC, Chicago, IL has been selected to help establish and manage a Job Order Contracting Services program encouraging the use from outside agencies/entities to piggyback onto our established program. 

 

There will be a fee added to non-City projects that would be charged to any outside agency/entity to use the JOC program.  This fee would be charged to the other party by F.H. Paschen, S.N. Nielsen and Associates, LLC and then passed through to the City.  The proposed fee schedule is attached as Exhibit A.

 

IMPACT STATEMENT:

Not approving this resolution will slow down the process to allow various agencies to use the City's JOC program as each agency would need to be approved individually through City Council action, which in turn could reduce usage (and the revenues gained by the City). 

 

RECOMMENDATIONS:

Approve the resolution to authorize the Director of Purchasing to enter into intergovernmental agreements with various agencies/entities to use the City of Aurora Job Order Contracting Services program.

WHEREAS, the City of Aurora has a population of more than 25,000 persons and is, therefore, a home rule unit under subsection (a) of Section 6 of Article VII of the Illinois Constitution of 1970; and

 

WHEREAS, subject to said Section, a home rule unit may exercise any power and perform any function pertaining to its government and affairs for the protection of the public health, safety, morals, and welfare; and

 

WHEREAS, The City wants to establish an intergovermental agreement(s) with various agencies/entities to allow the use of the City's Job Order Contracting Services program; and

 

WHEREAS, The agreement will establish a fee for the use of the City's program; and

 

 

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Aurora, Illinois, as follows: A Resolution authorizing the Director of Purchasing to enter into intergovernmental agreements with various agencies/entities to allow the use of the City of Aurora Job Order Contracting (JOC) program.
