Resolution to authorize the City of Aurora to enter into a ten (10) year License Agreement with the Fox Valley Park District (see attached) for the use and development of land located immediately south of the City of Aurora Animal Control and Care Facility located at 600 S River St.
PURPOSE:
To obtain City Council approval for the execution of a land use development agreement between the City of Aurora and the Fox Valley Park District which will allow for the expansion of the existing parking lot which services the Aurora Animal Control and Care Facility (see exhibit A).
BACKGROUND:
Due to an increase in activities, the Animal Control and Care Facility is in need of additional parking for guests and volunteers who visit the facility. The existing parking lot, owned by the City of Aurora is not adequate in terms of size which on many occasions forces overflow parking to the street.
DISCUSSION:
In order to address this matter, the Fox Valley Park District, which owns land directly south of the parking lot has agreed to allow the City of Aurora to improve, expand, construct and maintain an asphalt parking lot that can be used by visitors of the Animal Control and Care Facility in exchange for granting access and parking rights to the general public.
IMPACT STATEMENT:
This agreement will address a critical need for additional parking.

Requesting approval of the agreement.

WHEREAS, the City of Aurora has a population of more than 25,000 persons and is, therefore, a home rule unit under subsection (a) of Section 6 of Article VII of the Illinois Constitution of 1970; and
WHEREAS, subject to said Section, a home rule unit may exercise any power and perform any function pertaining to its government and affairs for the protection of the public health, safety, morals, and welfare; and
WHEREAS, the City of Aurora Animal Control and Care Facility, located at 600 S River Street is in need of additional parking and
WHEREAS, the Fox Valley Park District which owns land immediately south of the Aurora Animal Control and Care Facility's parking lot has agreed to allow the City to improve, expand, construct and maintain an asphalt parking lot that can be used by visitors and volunteers of the Aurora Animal Control and Care Facility in exchange for granting access and parking rights to the general public.
WHERAS, after the initial ten (10) year term, the license may be renewed for additional periods based upon mutual agreement between Fox Valley Park District and the City of Aurora.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Aurora, Illinois, as follows: That the mayor and City Clerk are hereby authorized to sign the attached License Agreement with Fox Valley Park District.
