Requesting approval for the issuance of a Circus License to Circo Hermanos Vazquez for a circus to be held at the Fox Valley Shopping Center on September 4 - 13, 2015.
PURPOSE:
Circo Hermanos Vazquez have applied for a Circus license to be held at the Fox Valley Shopping Center parking lot on Friday, September 4, 2015 from 7:00 p.m. to 11:00 p.m.; Saturday, September 5, 2015 from 7:00 p.m. to 11:00 p.m.; Sunday, September 6, 2015 from 2:00 p.m. to 10:00 p.m., Monday, September 7, 2015 from 7:00 p.m. to 11:00 p.m. Tuesday, September 8, 2015 from 7:00 p.m. to 11:00 p.m., Thursday, September 10, 2015 from 7:00 p.m. to 11:00 p.m., Friday, September 11, 2015 from 7:00 p.m. to 11:00 p.m., Saturday, September 12, 2015 from 6:00 p.m.to 11:00 p.m., Sunday, September 13, 2015 from 2:00 p.m. to 10:00 p.m. and Monday, September 14, 2015 from 7:00 p.m. to 11:00 p.m.
BACKGROUND:
Circo Hermanos Vazquez have been traveling the US performing since 1969. This will be the first time that Circo Hermanos Vazquez brings their event to the City of Aurora.
DISCUSSION:
The applicant has provided the required insurance document, a copy of the event layout, an application for an Operational Permit from the Fire Prevention Bureau.
City Staff (Fire Prevention, Police Department, Law Department and the City Clerk's office) will work closely with them to ensure additional requirements (Application Fee, Food and Beverage Tax Registration, Letter from Sponsoring Organization, Letter of Permission from Property Owner, USDA Licenses for Animals, Restoration/Performance Bond, Health Department Certificate and Circus Employee listing) are met prior to the issuance of a license. Additionally, as required by the State of Illinois, all operators, attendants and assistants will be appropriately screened, and a list of these employees will be provided to the office of the City Clerk prior to the event.
We are requesting an exception on two sections of the City of Aurora Carnival/Circus Ordinance.
Sec. 8-47. - Carnival or circus workers residing on premises.
No employee, agents or other representative of the carnival or circus may live, sleep or otherwise reside on the premises of the carnival or circus.
Circo Hermanos Vazguez is a traveling family circus. To contain cost for such a vast event, the performers and employees travel and reside in RV's throughout their performances. They are requesting permission to park their RV's and temporarily reside within the circus grounds.
Sec. 8-19. - Length, frequency of Operation.
No carnival, or circus, regardless of operator, shall be located on any one particular site more than two (2) times during any calendar year.
Circus Hermanos Vazguez requested a Circus License for the dates of September 4-14, 2015 to be held at Lot W, 351 N. River Street. Due to parking concerns, an alternate location for the Circus to perform was sought. After an extensive search for a location large enough to accommodate the event, the alternate location identified for the Circus is the Fox Valley Mall Parking lot. However, this location has already reached its allowable carnival/circus events, thus the request for an exception for Circus Hermanos Vazques.

WHEREAS, the City of Aurora has a population of more than 25,000 persons and is, therefore, a home rule unit under subsection (a) of Section 6 of Article VII of the Illinois Constitution of 1970; and
WHEREAS, subject to said Section, a home rule unit may exercise any power and perform any function pertaining to its government and affairs for the protection of the public health, safety, morals, and welfare; and
WHEREAS, Circo Hermanos Vazquez have applied for a Circus license to be held at the Fox Valley Shopping Center parking lot on Friday, September 4, 2015 from 7:00 p.m. to 11:00 p.m.; Saturday, September 5, 2015 from 7:00 p.m. to 11:00 p.m.; Sunday, September 6, 2015 from 2:00 p.m. to 10:00 p.m., Monday, September 7, 2015 from 7:00 p.m. to 11:00 p.m. Tuesday, September 8, 2015 from 7:00 p.m. to 11:00 p.m., Thursday, September 10, 2015 from 7:00 p.m. to 11:00 p.m., Friday, September 11, 2015 from 7:00 p.m. to 11:00 p.m., Saturday, September 12, 2015 from 7:00 p.m.to 11:00 p.m. and Sunday, September 13, 2015 from 2:00 p.m. to 10:00 p.m., Monday, September 14, 2015 from 7:00 p.m. to 11:00 p.m.; and
WHEREAS, Circo Hermanos Vazquez has paid all applicable fees and has agreed to provide final documentation prior to the issuance of the license sought; and
WHEREAS, pursuant to Aurora Code Sections 8-43 and 8-44, the City Council shall after review of a complete application, have the discretion to grant or deny the issuance of a carnival License.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Aurora, Illinois, as follows: that a Circus License be issued to Circo Hermanos Vazquez for September 4 - 14, 2015 at the Fox Valley Shopping Center parking lot.
