SUBJECT:

An Ordinance Authorizing the Execution of an Easement Agreement Between the City of Aurora and Fox Valley Habitat for Humanity, for the Properties Located at 1900 Jericho Road and the Southwest Corner of Jericho Road and South Edgelawn Drive. (Fox Valley Habitat for Humanity - 24-0159 / AU30/4-24.137-AG/M/E - SB - Ward 5)  

 

PURPOSE:

The Petitioner, Fox Valley Habitat for Humanity, is proposing an off-site easement agreement for stormwater drainage and maintenance for the properties located at 1900 Jericho Rd and the southwest corner of Jericho Rd and S Edgelawn Dr, to aid the development of the adjacent Habitat Green Freedom Subdivision at 1921 Jericho Rd.  

 

BACKGROUND:

The Petitioner, Fox Valley Habitat for Humanity, is requesting approval of an off-site easement agreement for stormwater drainage and maintenance to aid the development of the Habitat Green Freedom subdivision, which is located at 1921 Jericho Rd. The easement will extend to two (2) adjacent properties, which are on the south side of Jericho Rd: 1900 Jericho Rd and the vacant lot at the southwest corner of Jericho Rd and S Edgelawn Dr.

 

Concurrently with this proposal, the Petitioner is requesting approval of a Final Plat for Habitat Green Freedom subdivision, which is located at 1921 Jericho Rd. The lots are platted to satisfy the R-1, One Family Dwelling District’s minimum standards for lot width and lot area. The average residential lot area is approximately eleven thousand, six hundred (11,600) square feet, which exceeds the minimum lot area requirement of ten thousand (10,000) square feet. The residential lots are all meeting the minimum width requirement, at the building line, of seventy-five (75) feet. Garden Avenue runs through the center of the subdivision, and connects to Lindenwood Drive to the west with Jericho Road to the south. The Garden Avenue right-of-way is sixty-six (66) feet wide. Outlot 100 and Outlot 101 are dedicated for Stormwater Control Easements and City Easements.

 

Concurrently with this proposal, the Petitioner is requesting approval of a Final Plan for Habitat Green subdivision. The details of the request include development of seventeen (17) lots, which meet the applicable, minimum bulk restrictions per the R-1 zoning district’s standards for setbacks and ground floor area. The Petitioner has provided a Landscape Plan that meets the minimum landscaping requirements for a single-family residential subdivision, while also providing additional landscaping to screen the Subject Property from the adjacent residential properties to the west. The Landscape Plan also shows landscaping that screens the Detention Basin from the proposed adjacent residential lots, as well as the existing church to the east. The Petitioner has also provided exterior building elevations that indicate six (6) model types for one-story homes. Each model type exceeds the R-1 zoning district’s minimum ground floor area requirement of one thousand, one hundred-fifty (1,150) square feet. 

 

DISCUSSION:

Staff has reviewed the Easement Agreement petition and have sent comments back to the petitioner on those submittals. The Petitioner has made the requested revisions to these documents and they now meet the applicable codes and ordinances. 

 

POLICIES AND GUIDELINES:

The Staff’s Evaluation and Recommendation are based on the following Physical Development Policies:

 

12.1 (3):                     To encourage residential development in close proximity to places of work,

                                          shopping and recreation.

21.1 (1):                     To promote access to housing opportunities for all economic, racial, religious,

                                          ethnic and age groups.

22.1 (1):                     To achieve appropriate zoning protection for residential areas designated in the

                                          and use plan.  

 

RECOMMENDATIONS:

Staff would recommend approval of the ordinance authorizing the execution of an Easement Agreement Between the City of Aurora and Fox Valley Habitat for Humanity, for the properties located at 1900 Jericho Road and the Southwest Corner of Jericho Road and South Edgelawn Drive.

WHEREAS, the City of Aurora has a population of more than 25,000 persons and is, therefore, a home rule unit under subsection (a) of Section 6 of Article VII of the Illinois Constitution of 1970; and

 

WHEREAS, subject to said Section, a home rule unit may exercise any power and perform any function pertaining to its government and affairs for the protection of the public health, safety, morals, and welfare; and

 

WHEREAS, Rodney E. Feld and Julie A. Feld, Trustees of the Rodney E. Feld and Julie A. Feld Living Trust dated July 12, 2016, and Archangels Enterprises LLC Series 100, are, respectively, the owners of 1900 Jericho Rd, and Jericho Road & Edgelawn Dr, and have requested the City of Aurora to grant a Stormwater Drainage Easement and Maintenance Agreement; and

 

WHEREAS, the City is requesting the owner enter into the Easement Agreement attached hereto as Exhibit “A” with respect to the City granting said easement, which the owner has agreed to do.

 

NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Aurora, Illinois, that the City Council of the City of Aurora, Illinois, hereby approves the Easement Agreement attached hereto as Exhibit “A” with Fox Valley Habitat for Humanity, providing for the execution of an Easement Agreement between the City of Aurora and Gox Valley Habitat for Humanity, for the properties located at 1900 Jericho Road and the southwest corner of Jericho Road and South Edgelawn Drive.
