SUBJECT:

Resolution to approve a parking lot usage agreement with Opus Inspection Technologies, Inc., "Opus" for the purpose of providing a mobile emission testing public service at the Aurora Police Department. 

 

PURPOSE:

To authorize a parking lot usage agreement between Opus and the City of Aurora to allow Opus to conduct a mobile emission testing public service in the southeast parking lot of the Aurora Police Department.

 

BACKGROUND:

Illinois State Representative Barbara Hernandez, in partnership with Opus, has offered to provide mobile emissions testing as a free service to the public, to be offered on various dates in July 2025. 

 

DISCUSSION:

Representative Hernandez' office contacted the Aurora Police Department to discuss the possibility of offering a free mobile emissions testing service, and asked permission to utilize the southeast parking lot of the police department as the location for this event.  This area provides safe and efficient access to this mobile emissions testing service and is situated in a highly visible location.

 

There is no cost to the City of Aurora.  Opus has provided a parking lot usage agreement, which has been attached to this Resolution and includes satisfactory language regarding permitted use, indemnification, and insurance.

 

A site plan and proposed dates of this service have also been provided and attached to this Resolution as Exhibits A and B of the parking lot use agreement. 

 

IMPACT STATEMENT:

This agreement will have a direct and positive impact on our community through no-cost emissions testing for our motoring public.

 

RECOMMENDATIONS:

I request the proposed resolution be approved.

WHEREAS, the City of Aurora has a population of more than 25,000 persons and is, therefore, a home rule unit under subsection (a) of Section 6 of Article VII of the Illinois Constitution of 1970; and

 

WHEREAS, subject to said Section, a home rule unit may exercise any power and perform any function pertaining to its government and affairs for the protection of the public health, safety, morals, and welfare; and

 

WHEREAS, Illinois State Representative Barbara Hernandez, in partnership with Opus, has offered to provide mobile emissions testing as a free service to the public, to be offered on various dates in July, 2025; and

 

WHEREAS, Representative Hernandez' office contacted the Aurora Police Department to discuss the possibility of offering a free mobile emissions testing service, and asked permission to utilize the southeast parking lot of the police department as the location for this event.; and

 

WHEREAS, there is no cost to the City of Aurora; and

 

WHEREAS, Opus has provided a parking lot usage agreement, which has been attached to this Resolution and includes satisfactory language regarding permitted use, indemnification, and insurance.

 

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Aurora, Illinois, as follows: that a parking lot usage agreement with Opus Inspection Technologies, Inc., "Opus" for the purposes of providing a mobile emissions testing public service at the Aurora Police Department is hereby accepted and that the Mayor or his designee be authorized to sign and execute the necessary documents related to this agreement.
