SUBJECT: title
A resolution to amend the "Landscape Architecture Services Green Infrastructure Combined Sewer Overflow Control Project" contract with Hey and Associates 1444 N. Farnsworth Avenue, Suite 407 Aurora, Illinois 60505
body
PURPOSE:
To authorize the Mayor and City Clerk to amend an existing contract with Hey and Associates to assist the City in evaluating potential locations to construct improvements required as part of the City's Combined Sewer Overflow Long Term Control Plan (CSO LTCP). This amendment will add additional work to the current agreement with Hey and Associates that was awarded via resolution no. R12-234.
BACKGROUND:
In March 2010, the City of Aurora submitted a CSO LTCP to the Illinois and U.S. Environmental Protection Agencies in accordance with the City's CSO NPDES permit. The CSO LTCP includes sewer separation both by conventional methods and through the use of Green Infrastructure. The City's CSO LTCP is estimated to cost approximately $120M.

On June 26, 2012 City Council adopted a resolution authorizing the Mayor and City Clerk to enter into a financial assistance agreement with the Illinois Environmental Protection Agency for the construction of raingardens at 28 intersections throughout the City's combined sewer system. The financial assistance agreement provides $1,451,666.00 in funding through the IEPA's Illinois Green Infrastructure Grant Program (IGIG). The remaining costs to construct the raingardens will be provided from the CSO Long Term Control Plan Fee fund. The raingardens will be constructed within the public right of way, between the curb and sidewalk. The purpose for the raingardens is to remove stormwater from the combined system by promoting infiltration.

On August 28, 2012 the City Council authorized the Mayor and City Clerk to execute an agreement with Hey and Associates to provide assistance in completing the work required per the above mentioned IGIG financial assistance agreement. The existing contract with Hey and Associates is for the development of landscape architectural plans and bidding specifications as well as public outreach activities for 28 specific locations. However, during the design process the City has identified additional sites that may provide a better return on investment toward solving our CSO issues. This amendment will provide funds to pay for the evaluation of these alternate sites.
DISCUSSION:
This work is required in order to reduce the City's contribution to the violation of water quality standards within the Fox River. This amendment will increase the amount of Hey's contract value by $5,875.00 to a total not to exceed maximum of $38,950.00.

Funding has been provided for in the 2013 budget in B046 (Illinois Green Infrastructure - Bioinfiltration Basins), account no. 281-1852-512.81-31.

IMPACT STATEMENT:
This project will result in landscaped areas within the public right of way that will require ongoing maintenance.

RECOMMENDATIONS:
Please forward this item to the Buildings, Grounds, and Infrastructure Committee for their consideration.
