SUBJECT:

Resolution authorizing the City of Aurora to enter into Intergovernmental Agreement between the Kane County Emergency Telephone System Board, the City of Naperville on behalf of the Naperville Emergency Telephone System Board, the City of Aurora, and the Village of North Aurora authorizing the removal of the City of Aurora and the Village of North Aurora from the Kane County 9-1-1 system and the transfer of 9-1-1 service for the City of Aurora and the Village of North Aurora to the Naperville Emergency Telephone System Board

 

PURPOSE:

Resolutions 17-00073 and 17-00076 would allow Aurora to disconnect from its current Emergency System Telephone System Board (ETSB) (Kane County ETSB) and join the Naperville ETSB. This legislation also establishes the operation and function of the Naperville ETSB once Aurora and the Village of North Aurora are part of the Naperville ETSB. These resolutions further the purpose of the Memorandum of Understanding with the City of Naperville approved by the City Council in December 2015.)

 

BACKGROUND:

Aurora operates its own Public Safety Answering Point (PSAP) system, which receives emergency 9-1-1 calls and dispatches more than 100,000 calls annually for police, fire and ambulance services. The City currently is a member of the Kane County ETSB, which includes Kane Com and Tri-Com, which serve rural and small suburban towns while still operating on analog radio systems.  The recent changes to the ETSB Act and the regular partnership with the City of Naperville caused the City of Aurora to explore its ETSB options. As part of that exploration, the City Council approved a resolution and MOU with the City of Naperville for the Future Creation of a Joint Emergency Telephone System Board with the City of Naperville.

 

After researching the issue, it was determined that Aurora could not independently disconnect from its current ETSB and form a joint ETSB with Naperville without a change in the law. However, both Kane County ETSB and Naperville ETSB were willing to go through the process of modifying their 9-1-1- service boundaries to remove the City of Aurora and North Aurora from the jurisdiction of the Kane County ETSB and transfer the City of Aurora and North Aurora to the jurisdiction of the Naperville ETSB. Further, the proposed Intergovernmental Agreement with the City of Naperville ensures that the operation of the Naperville ETSB will be a partnership between City of Aurora and City of Naperville.

 

DISCUSSION:

The first Intergovernmental Agreement is a procedural agreement that authorizes the removal of the City of Aurora and the Village of North Aurora from the jurisdiction of the Kane County ETSB and also authorizes the transfer of the City of Aurora and the Village of North Aurora to the jurisdiction of the Naperville ETSB. Aurora is approving this Intergovernmental Agreement to indicate to the Illinois State Police that it is in agreement with this change in 9-1-1 service. After this Intergovernmental Agreement is adopted by all of the public bodies, the City of Naperville and Kane County will have to file modified plans with the Illinois State Police to modify the ETSB boundaries with respect to the City of Aurora and the Village of North Aurora.

 

The second Intergovernmental Agreement is an agreement between the City of Aurora, the Village of North Aurora and the City of Naperville that sets forth how the Naperville ETSB will function with the addition of City of Aurora and the Village of North Aurora. The Intergovernmental Agreement sets forth the expectations and understandings of the municipalities on how the ETSB will operate. Key aspects of this agreement include the following:

 

-  Aurora will continue to operate its own PSAP.

-  Dispatch services and all other functions of the police departments remain separate.

-  Surcharge funds collected from or attributable to City of Aurora and Village of North Aurora residents will be used only to support the Aurora PSAP.

-  Aurora will have representation on the ETSB Board. It is approximately five (5) members if you include the Aurora resident.

 

This Agreement ensures that the Naperville ETSB will function similar to a Joint ETSB and that Naperville and Aurora will continue to work together as partners, as envisioned by the MOU.

 

IMPACT STATEMENT:

Over the years, the City of Aurora has partnered with the City of Naperville to save millions of dollars through cooperative purchase agreements, including the purchase of the digital radio system.  Approving these Intergovernmental Agreements would preserve our ability to continue to engage in mutually beneficial partnerships with the City of Naperville for shared communication and resources, thus saving taxpayers money through increased efficiencies.

 

 

RECOMMENDATIONS:

Adopt the (1) Resolution Authorizing The City Of Aurora To Enter Into Intergovernmental Agreement Between The Kane County Emergency Telephone System Board, The City Of Naperville On Behalf Of The Naperville Emergency Telephone System Board, The City Of Aurora, And The Village Of North Aurora Authorizing The Removal Of The City Of Aurora And The Village Of North Aurora From The Kane County 9-1-1 System And The Transfer Of 9-1-1 Service For The City Of Aurora And The Village Of North Aurora To The Naperville Emergency Telephone System Board and (2) A Resolution Authorizing An Intergovernmental Agreement Between The City Of Naperville, The City Of Aurora, And The Village Of North Aurora Regarding The Function Of The Naperville Emergency Telephone System Board.

WHEREAS, the City of Aurora has a population of more than 25,000 persons and is, therefore, a home rule unit under subsection (a) of Section 6 of Article VII of the Illinois Constitution of 1970; and

 

WHEREAS, subject to said Section, a home rule unit may exercise any power and perform any function pertaining to its government and affairs for the protection of the public health, safety, morals, and welfare; and

 

WHEREAS, the City of Aurora has been a member of the Kane County ETSB 9-1-1 System since its inception; and


WHEREAS, the City of Aurora at all times has maintained under the authority of the Kane County ETSB a public safety answering point (hereinafter “PSAP”) at the Aurora Police Department which is responsible for answering 9-1-1 calls directed to the City of Aurora and to the Village of North Aurora and dispatching those calls to the appropriate public safety agency; and


WHEREAS, the City of Aurora and the Village of North Aurora recently came under the authority and jurisdiction of the Naperville ETSB; and


WHEREAS, the City of Aurora, Village of North Aurora and the City of Naperville are Illinois Municipal Corporations with the statutory power to enter into intergovernmental agreements between them, with the City of Aurora having an existing PSAP, and Naperville having an ETSB and an existing PSAP; and

 

WHEREAS, the City of Aurora and the City of Naperville have a history of collaboration to save taxpayers’ dollars by participating in joint purchasing agreements of police communications technology including a shared Harris Radio System and a joint video conference system; and


WHEREAS, the City of Naperville, the City of Aurora and the Village of North Aurora desire to set forth the operational and functional aspects of the Naperville ETSB in an Intergovernmental Agreement. 


WHEREAS, the Corporate Authorities of the City of Aurora, Kane, Kendall, Will and DuPage Counties, Illinois have considered an intergovernmental agreement (the “Intergovernmental Agreement”), a true and accurate copy of which is attached hereto and made a part hereof as Exhibit 1, between the City of Aurora, Village of North Aurora, and City of Naperville which establishes the operational and functional aspects of the Naperville ETSB, and


WHEREAS, the Corporate Authorities of the City of Aurora Kane, Kendall, Will and DuPage Counties, Illinois has determined that it is in the best interests and public safety of the residents of the City of Aurora to enter into this Intergovernmental Agreement; and)

 

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Aurora, Illinois, as follows:


                     Section 1:                      The Preambles hereto are hereby made a part of, and operative provisions of, this Resolution as fully as if completely repeated at length herein.


                     Section 2:                      The Mayor and City Council of the City of Aurora hereby find that it is in the best interests of the City of Aurora and its residents that the aforesaid Intergovernmental Agreement between the City of Aurora, Village of North Aurora, and City of Naperville be entered into by the City of Aurora, with said Intergovernmental Agreement to be substantially in the form attached hereto and made a part hereof as EXHIBIT 1. Any additional edits, revisions or amendments to the Intergovernmental Agreement subsequent to this approval are subject to the approval of the City Attorney and the Mayor.


                     Section 3:                     This Resolution shall take effect from and after its adoption and approval as required by law.
