SUBJECT:
Resolution to approve an Intergovernmental Agreement with the Fox Valley Park District for use of park facilities for July 4th activities in 2014 and 2015.  
 
PURPOSE:
An Intergovernmental Agreement (IGA) with the Fox Valley Park District (FVPD) is needed for the use of park facilities for the July 4 Fireworks Display and Evening Activities.  The agreement spells out the details of the use of the property and the responsibilities of both parties.
 
 
BACKGROUND:
It has been a long time goal of the Mayor to bring the fireworks back to the downtown after RiverEdge Park opened.   Last year, the Fireworks were finally brought back downtown.  In order to make this possible various FVPD facilities were needed for the venue and logistics.   Because the event went beyond the details that could be provided in a simple FVPD rental agreement, an IGA was developed to formalize the City's request and to spell out the details.
 
Last year's event went relatively smooth considering it was the first year in a new location.  A debrief meeting was held between city staff and FVPD staff.   The impact of the event on FVPD facilities was minimal and the City's cleanup efforts were acceptable to the FVPD.   
 
 
DISCUSSION:
The attached agreement is similar to the 2013 version.   The agreement formalizes what has been past practice at the previous fireworks location at Aurora Central Catholic High School (ACC) and the Illinois Mathematics and Science Academy (IMSA).  The main changes includes language for a two year agreement.  The additional year coincides with the current Fireworks vendor who will have the fireworks contract through 2015. No major changes in venue and logistics are foreseen for the next two years.  Also, additional language provides the City the ability to change the date of the Fireworks Show if necessary. The FVPD is agreeable to the two year agreement request.
 
A map of the FVPD property to be used for the July 4th Fireworks Display and Evening Activities is attached.
 
The Fireworks Display and Evening Activities are budgeted for in the Special Events budget.  
 
 
IMPACT STATEMENT:
The impact of this resolution will be minimal.  Last year the cleanup costs were no more than the preceding years when the event was held at the ACC and IMSA properties.
 
Required city services including road closures, staffing and other logistics will be included in a Special Event Permit to be brought before the GO Committee for review and approval.   
 
 
RECOMMENDATIONS:
Approval of the attached IGA with the FVPD is recommended.

WHEREAS, the City of Aurora has a population of more than 25,000 persons and is, therefore, a home rule unit under subsection (a) of Section 6 of Article VII of the Illinois Constitution of 1970; and
 
WHEREAS, subject to said Section, a home rule unit may exercise any power and perform any function pertaining to its government and affairs for the protection of the public health, safety, morals, and welfare; and
 
WHEREAS, the City of Aurora ("City") and Fox Valley Park District ("FVPD") are each legal entities organized and existing under the laws of the State of Illinois, having among their powers the authority to contract with one another to perform the undertaking described herein; and
 
WHEREAS, the City of Aurora and Fox Valley Park District seek to enter into an intergovernmental agreement regarding the use of Fox Valley Park District property for the staging of the 2014 and 2015 Independence Day fireworks show and other programmed activities;        
 
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Aurora, Illinois, as follows: that the Mayor of the City of Aurora and the City Clerk are hereby authorized and directed to execute the attached agreement on the behalf of the City.
