SUBJECT:
A resolution authorizing the execution of an intergovernmental agreement between the City of Aurora and the Village of Sugar Grove (Aurora Municipal Airport).
PURPOSE:
To renew and extend an existing intergovernmental relationship between the City of Aurora (the City) and the Village of Sugar Grove (the Village) regarding the Aurora Municipal Airport.
BACKGROUND:
In 1998, the City and the Village entered into an intergovernmental agreement to provide for the orderly development of the City's airport (located within the Village) and the development of surrounding properties. On July 14, 1998, the original IGA authorized by City resolution R98-252 expired.
Throughout the summer, City and Village staff have been working to make minor adjustments to the 1998 agreement which have been reviewed and approved by the City Departments and Divisions impacted by the changes. A redlined version of the document is attached for your review.
DISCUSSION:
There are no proposed changes that require additional expenditures by the City.
IMPACT STATEMENT:
Approval of the attached IGA will continue a mutually-beneficial relationship between the City and the Village

Please forward this resolution to the Finance Committee for their review and recommendation for approval.

WHEREAS, the City of Aurora has a population of more than 25,000 persons and is, therefore, a home rule unit under subsection (a) of Section 6 of Article VII of the Illinois Constitution of 1970; and
WHEREAS, subject to said Section, a home rule unit may exercise any power and perform any function pertaining to its government and affairs for the protection of the public health, safety, morals, and welfare; and
WHEREAS, Section 10 of Article VII of the Illinois Constitution of 1970 and the Intergovernmental Cooperation Act (5 ILCS 220/1 et seq.) provide authority for intergovernmental agreements regarding the sharing of powers and duties between, inter alia, local governmental units; and
WHEREAS, the City of Aurora owns, operates and maintains the Aurora Municipal Airport and all or portions of such airport are located within the corporate limits of the Village of Sugar Grove; and
WHEREAS, the City of Aurora and the Village of Sugar Grove desire to enter into an Intergovernmental Agreement concerning various aspects of the operation and maintenance of the Airport and certain related and adjacent functions and duties of the two municipalities; and
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Aurora, Illinois, as follows: that the Mayor and City Clerk are hereby authorized to execute the attached Intergovernmental Agreement, incorporated and made a part of this Resolution as if fully set forth herein as Exhibit A, concerning Aurora Municipal Airport and various aspects in relation thereto.
