A Planning and Development Committee Resolution Approving a Final Plan on Lot 1 of the Orchard Road Industrial Subdivision, located at the West Side of Deerpath Rd and North Side of I-88, for a Business and Professional, Office (2400) Use and Warehouse, Distribution and Storage Services (3300) Use (Panattoni Development Company, Inc. - 18-1046 / SG01/4-18.167-Fsd/Fpn - SB - Ward 5)  

 

PURPOSE:

The Petitioner, Panattoni Development Company, Inc., is requesting approval of a Final Plan for Lot 1 of the Orchard Road Industrial subdivision, located on the west side of Deerpath Road and on the northside of I-88 for a Business and Professional, Office (200) use and a Warehouse, Distribution and Storage Services (3300) use, which includes development of the site for an approximately 764,500 sq. ft. building on a 52.264 acre lot.  

 

BACKGROUND:

The subject property is currently zoned with ORI(S) Office, Research, and Light Industrial District with a Special Use Planned Development, which is part of the Bricks, Inc. Special Use Planned Development. This proposed Final Plat and Plan is in compliance with the approved Preliminary Plat & Plan Revision which was approved by the Aurora City Council on August 28, 2018 as R18-196.  Additional information on the legislative history of the property can be found in the attached Property Research Sheet.

 

The Petitioner is requesting approval of a Final Plan for Lot 1 of the Orchard Road Industrial subdivision.  Details of the request include the construction of a 764,500 square foot building for office and warehouse use.  The building will be approximately forty-two (42) feet tall.  Vehicles will be able to access the property from Deerpath Road to the east, and Orchard Gateway and Vision Court to the west.

 

Concurrently with this proposal, the Petitioner is requesting approval of a Final Plat for Lot 1 of the Orchard Road Industrial subdivision.  The details of the request include a single lot that is 52.264 acres, a forty (40) foot right-of-way dedication on the west side of Deerpath Road, and the granting of City Easements and Stormwater Control Easements throughout the site for future use. 

 

DISCUSSION:

Staff has reviewed the Final Plan petition and have sent comments back to the Petitioner based on those submittals.  The Petitioner has made the requested revisions to these documents and they now meet the applicable codes and ordinances, with the exceptions of the conditions identified in the Staff Recommendation below.. 

 

POLICIES AND GUIDELINES:

41.1 (1):                      To attract and encourage industrial, office, and office-research development to

                                          planned sites where requisite public facilities are either present or proposed.

41.1 (3):                     To encourage the location of industrial, office, and office-research development

                                          near transportation facilities designed to provide adequate and efficient linkages

                                          to sources of labor, production materials, and markets.

41.1 (5):                     To promote attractive, well-maintained industrial and office-research areas

                                          through landscaping and site design.  

 

RECOMMENDATIONS:

The Planning Commission recommended CONDITIONAL APPROVAL of the Planning and Development Committee resolution approving a Final Plan on Lot 1 of the Orchard Road Industrial subdivision, located at the west side of Deerpath Road and north side of I-88, for a Business and Professional, Office (2400) use and Warehouse, Distribution and Storage Services (3300) use, with the following conditions:

 

1) That the southernmost access to Deerpath Road is to be a right-in/right-out only.

WHEREAS, the City of Aurora has a population of more than 25,000 persons and is, therefore, a home rule unit under subsection (a) of Section 6 of Article VII of the Illinois Constitution of 1970; and

 

WHEREAS, subject to said Section, a home rule unit may exercise any power and perform any function pertaining to its government and affairs for the protection of the public health, safety, morals, and welfare; and

 

WHEREAS, by petition dated November 20, 2018, Panattoni Development Company, Inc. filed with the City of Aurora a petition requesting approval of a Final Plan for Lot 1 of the Orchard Road Industrial Subdivision, located on the west side of Deerpath Road and on the north side of I-88 for a Business and Professional, Office (2400) Use and a Warehouse, Distribution and Storage Services (3300) Use and related required documents as attached hereto as Exhibits "A-1" through Exhibit “A-3”; and

 

WHEREAS, after referral of said petition from the Aurora City Council, the Aurora Planning Commission on December 12, 2018, reviewed the petition and recommended CONDITIONAL APPROVAL of said petition; and

 

WHEREAS, on January 10, 2019, the Planning and Development Committee of the Aurora City Council reviewed said Final Plan and the before mentioned recommendations and recommended CONDITIONAL APPROVAL of said petition; and 

 

NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Aurora, Illinois, finds as facts all of the preamble recitals of this Resolution and hereby grants CONDITIONAL APPROVAL of said Final Plan with the following conditions:

1) That the southernmost access to Deerpath Road is to be utilized as a right-in/right-out only until the necessary Engineering review processes find a left-turn bay to be feasible.

BE IT FURTHER RESOLVED that the City Council of the City of Aurora hereby adopts the Final Plan and related required documents, as attached hereto as Exhibit "A-1" Final Plan, Exhibit “A-2” Landscape Plan, and Exhibit “A-3” Building and Signage Elevations, along with any easement dedications or vacations deemed necessary by the Aurora City Engineer.
