SUBJECT:

Resolution authorizing the City of Aurora to enter into an updated Memorandum of Understanding between the Drug Enforcement Agency (DEA), and the Aurora Police Department (APD).

 

PURPOSE:

An updated Memorandum of Understanding between the DEA and APD will allow for a continued response and investigation of the illegal trafficking of narcotics and dangerous drugs through a cooperative task force.

 

BACKGROUND:

The Aurora Police Department has had a long standing cooperative relationship with the DEA in which an Aurora Police Officer has been assigned to their drug task force to investigate and take enforcement action on the illegal trafficking of narcotics and dangerous drugs.

 

The DEA task force has been highly successful with investigations in Aurora, and within the region.  They are specifically tasked with the disruption of illicit drug traffic in the area by immobilizing targeted violators and trafficking organizations.  The task force gathers and reports intelligence data relating to the trafficking of narcotics and dangerous drugs, and also conducts undercover operations to assist in the prosecution of offenders.

 

The DEA task forces requests an Aurora Police Officer to remain part of the task force.  The APD will pay for the salary and benefits of the officer, including overtime.  However, as a part of this agreement the DEA will reimburse the APD for overtime payments of task force officer up to $18,649, as long as the City of Aurora maintains complete and accurate records of the accounts of the overtime expenditures.

 

This agreement is submitted yearly to the Aurora Police Department, due to the fact that the overtime reimbursement is a sum equivalent to 25% of the salary of a GS-12, step 1, RUS Federal employee.  As outlined, this value for 2020 will be $18,649.

 

DISCUSSION:

A new Memorandum of Understanding will outline the amount the Aurora Police Department is eligible to receive for reimbursement for overtime by the task force officer in 2020.  It will also show the Aurora Police Department’s continued commitment to the DEA drug task force.

 

 

 

 

 

IMPACT STATEMENT:

If this project is approved it can have a continued impact on the enforcement, seizure, and prosecution of those activities related to the illegal drug trafficking and dangerous drugs in the Aurora area.

 

RECOMMENDATIONS:

Adopt the updated Memorandum of Understanding between the DEA and the APD to continue to have an APD officer assigned to the DEA drug task force.

WHEREAS, the City of Aurora has a population of more than 25,000 persons and is, therefore, a home rule unit under subsection (a) of Section 6 of Article VII of the Illinois Constitution of 1970; and

 

WHEREAS, subject to said Section, a home rule unit may exercise any power and perform any function pertaining to its government and affairs for the protection of the public health, safety, morals, and welfare; and

 

WHEREAS, the Aurora Police Department has had a long standing cooperative relationship with the DEA in which an Aurora Police Officer has been assigned to their drug task force to investigate and take enforcement action on the illegal trafficking of narcotics and dangerous drugs; and

NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Aurora, Illinois, finds as facts all of the preamble recitals of this Resolution and hereby adopts the updated Memorandum of Understanding between the DEA and the APD to continue the DEA drug task force.
